`The present application is being examined under the pre-AIA first to invent

`Claim Rejections - 35 USC § 102
`
`The following is a quotation of the appropriate paragraphs of pre-AIA 35 U.S.C.

`102 that form the basis for the rejections under this section made in this Office action:

`A person shall be entitled to a patent unless —

`(b) the invention was patented or described in a printed publication in this or a foreign country
`or in public use or on sale in this country, more than one year prior to the date of application
`for patent in the United States.
`
`(e) the invention was described in (1) an application for patent, published under section
`122(b), by another filed in the United States before the invention by the applicant for patent or
`(2) a patent granted on an application for patent by another filed in the United States before
`the invention by the applicant for patent, except that an international application filed under
`the treaty defined in section 351 (a) shall have the effects for purposes of this subsection of an
`application filed in the United States only if the international application designated the United

`rather than function. A claim containing a “recitation with respect to the manner in

`With respect to claim 17, Koch teaches a cap magazine (1 b) comprising: a cap
`
`carrier (5a, 5b) sized and shaped to receive a plurality of spot welding caps (20) ; and
`
`an actuator (feather/spring 6) for driving the spot welding caps within the cap carrier, the
`
`actuator providing an advancing force to advance the caps one by one so that one of
`
`the caps moves to an access position (11), the access position allowing one of the spot
`
`welding caps to be attached axially to the shaft of the pincer spot welding head and to
`
`be extracted from the cap carrier with the shaft of the pincer spot welding head, and
`
`when the cap in the access position is extracted from the cap carrier, the actuator
`
`advances another one of the caps into the access position (figures 1-5; and the
`
`translation provided by the applicant). Note that the magazine configuration of Koch is
`
`capable of performing the claimed function.
`
`With respect to claim 18, Koch teaches a stop (21) for successively retaining
`
`each cap in the access position.
`
`With respect to claim 19, Koch teaches wherein the actuator includes a spring
`
`box (6, 7).

`With respect to claim 23, Koch teaches wherein the cap carrier is sized and

`shaped to receive the spot welding caps in a circular arrangement (figure 5; and
`
`translation).

`Claims 17-18 are rejected under pre-AIA 35 U.S.C. 102e as being anticipated
`
`by Louzier (FR-2874523A1).
`
`The intended use of the instantly claimed apparatus is noted, however, the
`
`intended use does not patentably distinguish said claimed apparatus over the prior art.
`
`While features of an apparatus may be recited either structurally or functionally, claims
`
`directed to an apparatus must be distinguished from the prior art in terms of structure
`
`rather than function. A claim containing a “recitation with respect to the manner in
`
`which a claimed apparatus is intended to be employed does not differentiate the
`

`welding caps (electrodes); and an actuator (thrust system 41) for driving the spot
`
`welding caps within the cap carrier, the actuator providing an advancing force to
`
`advance the caps one by one so that one of the caps moves to an access position (47),

`extracted from the cap carrier, the actuator advances another one of the caps into the
`
`access position (abstract; and figures 5-9). Note that the magazine/cartridge
`
`configuration of Louzier is capable of performing the claimed function.
`
`With respect to claim 18, Louzier teaches a stop (46, 46a) for successively
`
`retaining each cap in the access position.
`
`Double Patenting
`
`The nonstatutory double patenting rejection is based on a judicially created
`
`doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the
`
`unjustified or improper timewise extension of the “right to exclude” granted by a patent
`
`and to prevent possible harassment by multiple assignees. A nonstatutory double
`
`patenting rejection is appropriate where the claims at issue are not identical, but at least
`
`one examined application claim is not patentably distinct from the reference claim(s)
`
`because the examined application claim is either anticipated by, or would have been
`
`obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d
`
`1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir.
`
`1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum,
`
`686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619
`
`(CCPA 1970); and In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).

`17. (Currently Amended) A cap magazine for use with a
`
`cap extractor that detaches a spot Welding cap of a pincer spot Welding
`
`head inserted into the cap extractor from a shaft of the pincer Welding
`
`head, the cap magazine comprising:
`
`a cap carrier sized and shaped to receive a plurality of spot
`
`Welding caps; and
`
`an actuator for driving the spot Welding caps Within the cap
`
`carrier, the actuator providing an advancing force to advance the caps
`
`one by one so that one of the caps moves to an access position, the
`
`access position allowing one of the spot Welding caps to be attached
`
`axially to the shaft of the pincer spot Welding head and to be extracted
`
`from the cap carrier With the shaft of the pincer spot Welding head, and
`
`when the cap in the access position is extracted from the cap carrier, the
`
`actuator advances another one of the caps into the access position;
`
`wherein the actuator includes a spring box; and

`a cap extractor having a gripper which in response to a
`
`turning and axial extraction movement detaches a spot welding cap of a
`
`pincer spot welding head inserted into the gripper from a shaft of the
`
`pincer spot welding head in such a way that the spot welding cap is
`
`clamped by the gripper to prevent the spot welding cap from twisting;
`
`and
`
`at least one cap magazine including: a cap carrier sized and
`
`shaped to receive a plurality of spot welding caps, and an actuator for
`
`driving the spot welding caps within the cap carrier, the actuator
`
`providing an advancing force to advance the caps one by one so that one
`
`of the caps moves to an access position, the access position allowing one
`
`of the spot welding caps to be attached axially to the shaft of the pincer
`
`spot welding head and to be extracted from the cap carrier with the shaft
`
`of the pincer spot welding head, and when the cap in the access position
`
`is extracted from the cap carrier, the actuator advances another one of
`
`the caps into the access position.
`

`according to claim 24, wherein the gripper includes at least one moveable
`
`gripping element for engaging the spot welding cap.

`rotated towards each other with approximately parallel toothed grip
`
`surfaces whose distance is smaller than a diameter of a spot welding cap.

`according to claim 26, wherein respectively one of the jaws is fixed jaw at
`
`a jaw plate, and the other jaw is a movable jaw formed at a U—shaped jaw

`arm, which is supported with a pivot joint behind the fixed jaw.

`according to claim 27, further comprising a preloaded spring mounted to

`the moveable jaw for biasing the moveable jaw toward the fixed jaw.
