`Joint Submission request to W3C by W3C Members Marimba, Inc., Netscape Communications Corp., Novell,

` We, Marimba, Inc. (in conjunction with Netscape, Novell, Sun Microsystems and @Home: please see separate
` submission declaration) hereby submit to the Consortium the following specification comprising the document(s)
` linked below:

`1. HTTP Distribution and Replication Protocol
`
` which collectively are referred to as "the submission". We request the submission be known as the "DRP" submission.
` Abstract
` This document provides a specification of a protocol for the efficient replication of data over HTTP.
` Intellectual property Rights
` Each co-submitter ("Submitters") of DRP agrees not to assert any Patent Claim against any third-party arising from the
` use, manufacture, sale, distribution, or implementation of any portion of any product, method, or procedure which is
` necessary to implement the DRP. Patent Claim means claim(s) of a patent or patent application which are owned or
` controlled by a Submitter that must be infringed in order to make, use or implement a product, method, or procedure
` that implements the DRP. DRP means the HTTP Distribution and Replication Protocol as initially submitted and/or
` adopted by the W3C or equivalent standards body. DRP does not include subsequent versions adopted by the standards
` bodies unless such subsequent version is again mutually submitted by Submitters.
`
` A condition of any Submitter agreeing to not assert Patent Claims against any third-party is that such third-party agree
` in return not to assert against such Submitter any claim(s) of a patent or patent application which are owned or
` controlled by such third-party that must be infringed in order to make, use or implement a product, method, or
` procedure that implements the DRP.
`
` Submitters mutually grant each other a non-exclusive, royalty-free, worldwide, perpetual license under their Patent
` Claims, to make, have made, use, import, sell, offer to sell, license or otherwise dispose of products or implement
` procedures or methods which comply with the DRP.
`
` Each Submitter expressly reserves all other rights it may have in the material and subject matter of this contribution.
`
` Each Submitter expressly disclaims any and all warranties regarding this contribution including any warranty that this
` contribution does not violate the rights of others or is fit for a particular purpose.
`

` The following points should be noted as regards licensable technology involved in any third party implementations of
` the technology specified in the submission: There are no known issues at this time beyond typical platform- and
` implementation-dependent software engineering.
` Suggested action
` We suggest that the Consortium consider this proposal as part of the Push Workshop scheduled for September, 1997.
` Resources
` Marimba can not commit resources at this time however we look forward to providing assistance from time to time.
