`The Examiner acknowledges the claims‘ novelty over

`Alten, and relies upon Florin to provide the claimed display

`of "a currently broadcast television program" {Office action,

`p. 9). Applicants respectfully submit that one of ordinary
`
`skill in the art would not be motivated to make this alleges
`
`combination.
`
`Generally speaking, Alten discloses two main types
`
`of embodiments.
`
`In the first type of embodiment,
`
`the program
`
`guide is completely passive. That is,
`
`the guide is generated
`
`remotely at a head~end and transmitted as a television
`
`programming signal over a television channel to the user‘s
`
`television for viewing (Alten, col. 8, ll.
`

`desiring to View the passive guide tune their cable
`
`television converter box to the proper channel {Alten,
`
`coi. 8, ll. 28~29; col. 14, ll. 58~62). Applicants

`respectfully submit that one simply cannot get to the claimed

`approach from this embodiment for one fundamental reason ~

`the tuner in this embodiment is used to provide the guide
`
`itselfi.

`The tuner cannot also be used to provide a
`
`simultaneous display of a currently~broadcast television
`
`program without obliterating the guide.

`In Alten's "alternate embodiment," interactive
`
`program schedule information is overlaid onto the passive
`
`program guide channel to create a hybrid interactive/passive
`
`guide {Alten, col. 14, ll. 6-15}. This embodiment gives the
`
`user some control over the listings, while eonfiinuing to
`
`provide the promotional videos of Alten*s passive program
`
`guide channe 1 .
`
`Alten specifically teaches that the promotional
`
`videos are to be retained.
`
`The interactivity is provided as
`
`an "add on” to the basic promotional videos:
`
`the display environment of the disclosed guide
`Thus,
`channel can be retained, but
`the listings portion of
`the guide controlled locally by the subscriber's
`Converter box. In this manner,
`the video—dominant

`features of the guide channel are retained, such as
`the promotional video clips.

`that it combines the advantage of a guide channel

`video clips-—with the benefit of user control over

`Thus, one of ordinary skill would not make the

`proposed combination because it {a} flies in the face of the
`
`express teachings of Alten, and (b) would frustrate one of

`promotions. Applicants respectfully submit that gutting the

`reference cf its basic teaching (i.e.,

`For at least the above reasons, applicants
