`

`
`Applicants’
`
`independent claims 1, 9, 21 and 23 are
`
`directed towards methods and a system for simultaneously
`
`displaying a plurality of television program listings in a
`
`first area of a screen, a currently broadcast television
`
`program in a second area of the screen, and a detailed
`
`program description of the currently broadcast televisioa
`
`13
`
`13
`
`13
`
`
`
`program displayed in the second area of the screen in a third
`
`area of the screen.
`
`The Examiner acknowledges the claims‘ novelty over
`
`Alten, and relies upon Florin to provide the claimed display
`
`of "a currently broadcast television program" {Office action,
`
`p. 9). Applicants respectfully submit that one of ordinary
`
`skill in the art would not be motivated to make this alleges
`
`combination.
`
`Generally speaking, Alten discloses two main types
`
`of embodiments.
`
`In the first type of embodiment,
`
`the program
`
`guide is completely passive. That is,
`
`the guide is generated
`
`remotely at a head~end and transmitted as a television
`
`programming signal over a television channel to the user‘s
`
`television for viewing (Alten, col. 8, ll.
`
`i~32}. Users
`
`desiring to View the passive guide tune their cable
`
`television converter box to the proper channel {Alten,
`
`coi. 8, ll. 28~29; col. 14, ll. 58~62). Applicants
`
`respectfully submit that one simply cannot get to the claimed
`
`approach from this embodiment for one fundamental reason ~
`
`the tuner in this embodiment is used to provide the guide
`
`itselfi.
`
`The tuner cannot also be used to provide a
`
`simultaneous display of a currently~broadcast television
`
`program without obliterating the guide.
`
`14
`
`14
`
`14
`
`
`
`In Alten's "alternate embodiment," interactive
`
`program schedule information is overlaid onto the passive
`
`program guide channel to create a hybrid interactive/passive
`
`guide {Alten, col. 14, ll. 6-15}. This embodiment gives the
`
`user some control over the listings, while eonfiinuing to
`
`provide the promotional videos of Alten*s passive program
`
`guide channe 1 .
`
`Alten specifically teaches that the promotional
`
`videos are to be retained.
`
`The interactivity is provided as
`
`an "add on” to the basic promotional videos:
`
`the display environment of the disclosed guide
`Thus,
`channel can be retained, but
`the listings portion of
`the guide controlled locally by the subscriber's
`Converter box. In this manner,
`the video—dominant
`
`features of the guide channel are retained, such as
`the promotional video clips.
`(Alten, col. 14,
`
`ll.
`
`lO~l5, emphasis added).
`
`The advantage of the above program guide
`channel/interactive electronic program guides is
`that it combines the advantage of a guide channel
`system~~the video features including promotional
`video clips-—with the benefit of user control over
`
`display of selected program schedule information as
`opposed to waiting for the desired information to
`appear.
`(Alten, col. 14,
`l. 63 ~ col. 15, l. 2,
`emphasis added).
`
`Thus, one of ordinary skill would not make the
`
`proposed combination because it {a} flies in the face of the
`
`express teachings of Alten, and (b) would frustrate one of
`
`the basic purpose of the hybrid guide — to provide video
`
`15
`
`15
`
`15
`
`
`
`promotions. Applicants respectfully submit that gutting the
`
`reference cf its basic teaching (i.e.,
`
`to retain the
`
`promotional videos)
`
`in favor of its “add on" feature thereby
`
`arriving at the claimed approach is the very essence at
`
`impermissible hindsight.
`
`For at least the above reasons, applicants
`
`respectfully submit that independent claims 1, 9, 21 and 23
`
`are patentable over the proposed combinations and that the
`
`pending rejections shculd be withdrawn. Claims 3~6,
`
`l1«l4
`
`and 25«28 depend from independent claim 1, 9, 21 or 23.
`
`Accordingly,
`
`the rejection of these dependent claims should
`
`also be withdrawn.
`
`("If an independent claim is nonobvious
`
`under 35 U.S.C. 103,
`
`then any claim depending therefrom is
`
`nonebvious.“
`
`In re Fine, 837 F.2d 1071,
`
`5 USPQ2d 1596 (Fed.
`
`Cir.
`
`l988); MPEP § 2143.}
`
`For at least the reasons set forth above,
`
`applicants respectfully submit that claims 1, 3-6, 9,
`
`l1«l4
`
`21, 23, 2S~28 are allowable.
`
`16
`
`16
`
`16
`
`
`
`Conclusion
`
`The ioregoing demonstrates that claims 1«30 are
`
`W
`
`llowable. Reconsideration and allowance are accordingly
`
`resyectfully requested.
