`The parties to this case are involved in parallel proceedings in the U.S. District Court for
`
`the Eastern District of Michigan, Civil Action No. 15-cv-10628. On October 22, 2015, the parties
`
`notified this court that an October 14, 2015 Opinion and Order was entered in that case by the Hon.
`
`Matthew F. Leitman. [Dkt. # 67]. Judge Leitman denied Versata’s Motion to Dismiss, or
`
`Alternatively to Transfer to the Eastern District of Texas. [Dkt. # 67-1]. On November 5, 2015,
`
`this court gave the parties until November 30, 2015 to file notice of any good faith reasons that this
`
`case should not be dismissed, without prejudice, so that the issues may be dealt with by the
`
`Michigan court. [Dkt. # 68]. Only Plaintiff responded, stating that it was not opposed to dismissal.
`
`[Dkt. # 69].
`
`Based on Judge Leitman’s ruling and the fact that neither party has provided arguments
`
`against dismissing the case, it is ORDERED that this case is DISMISSED without prejudice to
`
`Plaintiff’s ability to assert its claims in the Michigan court.
`
