`Petitioner Swagway, LLC (“Petitioner”) hereby requests a refund in the
`
`amount of $14,000 corresponding to the post-institution fee paid on October 14,
`
`2016 in accordance with 37 CFR § 42.15. On April 27, 2017, the Patent Trial and
`
`Appeal Board (“Board”) issued a decision terminating the proceeding prior to
`
`institution pursuant to a settlement agreement. On May 26, 2017, the Petitioner
`
`filed a Request for Reconsideration of the Board’s decision. On February 4, 2019,
`
`the Board denied the Petitioner’s Request for Reconsideration. Therefore, post-
`
`institution fees should be refunded.
`
`Petitioner authorizes the United States Patent and Trademark Office to credit
`
`the $14,000 refund to Deposit Account No. 50-4840 or issue a check of $14,000
`
`payable to Mei & Mark LLP, P.O. Box 65981, Washington, DC 20035-5981.
`
