`
`REMARKS
`
`Based on these Remarks, the applicants respectfully request that the rejections
`
`set
`
`forth in the Office Action mailed February 13, 2013 (the “Office Action”) be
`
`withdrawn.
`
`The applicants have reviewed the Office Action and respectfully submit that each
`
`objection and rejection raised in the Office Action has been appropriately resolved
`
`herein. Each objection and rejection is addressed below, preceded by a heading similar
`
`to that found in the Office Action.
`
`Claims 28, 30-36, 38, 39, 41, 46-55, 83-89, 91, 92, 94, 104-116 were pending
`
`when the present Office Action was mailed.
`
`In this Response, claims 28, 30-36, 38, 39,
`
`41, 46-55, and 1 15 have been cancelled. The foregoing claims have been cancelled for
`
`the purpose of expediting prosecution of the present application, without conceding the
`
`merits of the rejections of these claims, and without prejudice to pursuing these claims
`
`in unamended or other forms in a continuation or other application. Accordingly, claims
`
`83-89, 91, 92, 94, 104-114, and 116 are currently pending.
`
`As an initial matter, applicants wish to thank the Examiner for allowing claims 82-
`
`89, 91, 92, 94, 104-114, and 116. The applicants have cancelled the claims that were
`
`either objected to or rejected in the Office Action. Accordingly, all pending claims have
`
`been indicated to be allowable, and applicants request a Notice of Allowance.
`
`I.
`
`Claim Rejections -- 35 USC § 103
`
`In the Office Action, claims 28, 32, 33, 35, 36, 38, 39, 41, 51-53 and 115 were
`
`rejected under Section 103 over U.S. Patent No. 6,934,858 to Woodhill ("Woodhill"),
`
`U.S. Patent No. 8,024,567 to Han ("Han"), and U.S. Patent No. 7,389,913 to Starrs
`
`("Starrs"); and claims 30, 31, 34 and 45-50 were rejected under Section 103 over
`
`Woodhill, Han, Starrs and U.S. Patent Publication No. 2001/0032192 to Putta et al.
`
`("Putta").

`Reply to Office Action of February 13, 2013
`
`DocketNo 827978001US2
`
`In this response, claims 28, 30-36, 38, 39, 41, 46-53 have been cancelled.
`
`Applicants therefore request that the Section 103 rejections be withdrawn.
`
`II.
`
`Allowable Subject Matter
`
`Claims 83-89, 91, 92, 94, 104-114 and 116 were indicated to be allowable.
`
`Claims 54 and 55 were objected to as being dependent upon a rejected base claim, but
`
`would have been allowable if
`
`rewritten in independent
`
`form including all of
`
`the
`
`limitations of the base claim and any intervening claims.
`
`In this response, claims 54 and 55 have been cancelled. Only allowable claims
`
`83-89, 91, 92, 94, 104-114 and 116 remain pending. Although the applicants‘ attorney
`
`agrees with the Examiner's conclusion that these claims are allowable, the applicants‘
`
`attorney notes that the claims may be allowable for reasons other than those identified
`
`by the Examiner and does not concede that the Examiner's characterization of the
`
`terms of the claims and the applied references are correct.
`
`III.
`
`Conclusion
`
`In view of the above amendment, applicants believe the pending application is in
`
`condition for allowance.
`
`If the Examiner has any questions or believes a telephone
`
`conference would expedite prosecution of this application, the Examiner is encouraged
`
`to call the undersigned at (206) 359-8288.
`
`Although the present communication may include alterations to the application or
`
`claims, or characterizations of claim scope or referenced art, the applicants are not
`
`conceding that previously pending claims are not patentable over the cited references;
`
`instead, any alteration or characterizations are being made to facilitate expeditious
`
`prosecution of this application.
`
`The applicants reserve the right to later pursue any previously pending or other
`
`broader or narrow claims that capture any subject matter supported by the present
