`authorizing Patent Owner to file a Request for Certificate of Correction

`Under 35 U.S.C. § 254 as follows:

`Patent Owner is authorized to file a Request for

`Certificate of Correction Under 35 U.S.C. § 254 ("§ 254
`
`Request") with the Director. The § 254 Request must be
`
`filed no later than Friday, December 2, 2016. A copy of
`
`that filing shall be entered as an exhibit in the record of
`
`this proceeding by no later than Friday, December 2,
`
`2016.
`
`In accordance with the foregoing instruction that a copy of the
`
`filing be entered as an exhibit in this IPR proceeding, Patent Owner herewith
`
`submits Exhibit 2009, comprising copies of the § 254 Request and the
`
`proposed Certificate of Correction. The original § 254 Request and
`
`proposed Certificate of Correction are being sent to the Commissioner of
`
`Patents via United States Postal Service Express Mail today, December 1,

`The Patent Owner respectfully requests a certificate of

`correction under 35 U.S.C. § 254 to correct the Patent Office's mistake in
`
`issued claims 14, 16, 21, 25, 28, and 38 of U.S. Patent No. 6,716,602 (the
`
`'602 Patent). Accompanying this request is Form PTO/SB/44, a proposed
`

`Certificate of Correction. This patent is the subject of IPR2016-01608. In
`
`an email from Maria Vignone, Paralegal Operations Manager, dated
`
`December 1, 2016, the Patent Trial And Appeal Board authorized the filing
`
`of this request under 37 C.F.R. § 42.22, no later than December 2, 2016.
`
`The requested Correction adds no new matter and is clearly disclosed by the
`
`'602 Patent's prosecution history in the records of the Patent Office.
`
`During prosecution of the '602 patent, an amendment, dated
`
`August 1, 2003, was submitted and received by the Patent Office on August
`
`4, 2003 (the "Amendment"). The Amendment was acknowledged in the
`
`Notice of Allowability that issued on November 10, 2003. In issuing the
`
`claims, however, the Patent Office failed to include changes that were made
`
`by the Amendment to those claims that issued as claims 14, 16, 21, 25, 28,
`
`and 38.
`
`In particular, the Amendment included the addition of wherein
`
`clauses and other changes to each of pending claims 15 (issued claim 16)
`
`and 24 (issued claim 25):

`Claim 15 (currently amendod): A method of increasing product yield of a
`
`properly folded antibody, growth factor, or jnaramalian protease produced by a
`recombinant E. coli host ceil, wherein expression of the antibody, growth
`factor, or protease is regulated by an inducible system, which method
`
`comprises
`
`(a)
`
`culturing the host cells under conditions of high metabolic
`
`and growth rate; and
`
`(b)
`
`reducing th_e metabolic rate of the cultured recombinant host
`
`cells at the time of induction of antibody, growth factor, or
`
`protease expression, wherein the_reductiorT in metabolic rate
`
`results in increased yield of properly folded antibody,
`
`growth factor, or protease.
`
`Amendment at 11-12.
`
`Claim 24 (currently amended!: A method for increasing product yield of a
`
`properly folded mammalian polypeptide of interest produced by recombinant
`
`host cells, wherein expression of the polypeptide by the recombinant host
`
`cells is regulated by an inducible system, which method comprises
`
`(a)
`
`culturing the recombinant host cells under conditions of
`
`high metabolic and growth rate; and
`
`(b)
`
`reducing the metabolic rate of the Cultured recombinant
`
`host cells at the time of induction of polypeptide
`
`expression, wherein the reduction in metabolic rate results
`
`in increased yield of properly folded mainaalian p.olyEgEtido.

`Amendment at 12-13.
`
`The Amendment also included the following amendments to
`
`pending claim 13 (issued claim 14), pending claim 20 (issued claim 21),
`
`pending claim 27 (issued claim 28), and pending claim 36 (issued claim 38),
`
`adjusting claim dependencies and removing "or other form of antibody":

`Claim 13 (currently amended!: The method according to claim 4? 3§, wherein the
`
`polypeptide is selected from the group consisting of an Fab'j antibody and -an
`
`Fab antibody og other 'form &f antibody.
`
`Claim 20 {currently amended): The method according to claim 1$ 19, wherein
`
`the carbon/energy source is glucose.
`
`Claim 21 {currently araendod): The method according to claim *4 26, wherein
`
`the carbon/energy source is glucose.
`
`Claim 36 {currently amended): The method according to claim 54 .39, wherein
`
`the polypeptide is selected from the group consisting of an Fab'2 antibody and
`
`an Fab antibody'or other form of antibody.
`
`Following the Amendment, the Examiner issued a Notice of
`
`Allowability, mailed November 10, 2003, which acknowledged the
`
`Amendment by stating: "This communication is responsive to the
`
`amendment filed 4 August 2003." Notice of Allowability (November 10,
`
`2003) at 1 (emphasis in original).
`
`Upon payment of the issue fee, all of the pending claims issued.
`
`New claim 38 became issued claim 13, thereby incrementing the claims that
`
`followed by one number. New claim 39 became issued claim 37,
`
`incrementing claims that followed that claim by two numbers.
`
`As a result, pending claim 13 became issued claim 14, pending
`
`claim 15 became issued claim 16, pending claim 20 became issued claim 21,
`

`pending claim 24 because issued claim 25, pending claim 27 became issued
`
`claim 28, and pending claim 36 became issued claim 38.
`
`Accordingly, issued claims 14, 16, 21, 25, 28, and 38 should be
`
`corrected to reflect the Amendment, as shown in the accompanying
`
`proposed Certificate of Correction.
`
`Conclusion
`
`For the stated reasons, the Patent Owner respectfully requests a
`
`certificate of correction under 35 U.S.C. § 254 as to claims 14, 16, 21, 25,
`
`28, and 38.
