`
`Re:
`
`Chrimar Systems, Inc. et al. v. Juniper Networks, Inc., N.D. Cal. Case
`No. 3:16-CV-00558 (SI); Chrimar Systems, Inc. et al. v. Ruckus Wireless,
`Inc., N.D. Cal. Case No. 3:16-cv-00186 (SI), Chrimar Systems, Inc. et al. v.
`NETGEAR, Inc., N.D. Cal. Case No. 3:16-cv-00624 (SI), and Chrimar
`Systems, Inc. et al. v. Fortinet, Inc., N.D. Cal. Case No. 3:16-cv-00897 (SI)
`
`Dear Judge Illston:
`
`The parties write to provide a status report regarding the Patent Trial and Appeal
`Board's ("PTAB") institution of Juniper's four inter partes review ("IPR") petitions, and the
`status of all other IPR and reexamination proceedings involving the four Patents-in-Suit.1
`
`On September 26, 2016, the Court granted Defendants' motion to stay the above
`referenced actions against Juniper, Ruckus Wireless, NETGEAR, and Fortinet until the
`PTAB reaches institution decisions with respect to four IPR Petitions filed by Juniper. Dkt.
`No. 79 (the "Stay Order"). In the Stay Order, the Court requested that the parties provide a
`status update regarding all IPR and reexamination proceedings within ten days of the
`PTAB's institution decisions on Juniper's IPRs, at which time the Court stated that it may
`either lift or continue the stay. Id. at 10. This letter provides that status update.
`
`1.
`
`Juniper IPRs
`
`On January 25, 2017, the PTAB issued its decision on the fourth pending Juniper
`Petition. Following that decision, inter partes review is now instituted for all four of
`Juniper's Petitions and on all asserted claims of the Patents-in-Suit. In addition, the PTAB
`instituted trial on both of the invalidity grounds presented in each of Juniper's IPR petitions.
`
`1 U.S. Patent No. 8,155,012 (the "'012 patent"), U.S. Patent No. 8,942,107 (the "'107
`patent"), U.S. Patent No. 8,902,760 (the "'760 patent") and U.S. Patent No. 9,019,838 (the "'838
`patent") (collectively, "The Patents-in-Suit").
