`Petitioner’s August 28, 2017 Motion to Exclude Patent Owner’s evidence under 37
`
`C.F.R. § 42.64. Paper 26. On August 30, 2017, the Board issued an Order
`
`expunging Patent Owner’s Motion for Observation (Paper 24) and Exhibits 2011
`
`and 2012, and authorizing Patent Owner to refile the same observations without
`
`any citations to Exhibits 2011 and 2012. Paper 27 at 3. On September 1, 2017,
`
`Patent Owner filed a Corrected Motion for Observation as the Board authorized.
`
`Paper 28. In light of the Board’s Order (Paper 27) and Patent Owner’s filing of the
`
`Corrected Motion for Observations (Paper 28) which resolved the issues presented
`
`in the motion, Petitioner has agreed “to withdraw its motion to exclude as moot.”
`
`Ex. 2014. Therefore, Petitioner’s Motion to Exclude is moot.
