`

`IPR2016-01730
`MOTION TO WITHDRAW COUNSEL
`
`I. RELIEF REQUESTED
`Pursuant to 37 C.F.R. § 42.10(e), and as authorized by the Board in an e-
`
`mail dated October 27, 2017, Petitioner Koios Pharmaceuticals requests that the
`
`Board withdraw current lead counsel DeAnn F. Smith as counsel from this
`
`proceeding. Additionally, per instructions in the Board’s e-mail, Petitioner notes
`
`that the Board has authorized back-up counsel Kayvan B. Noroozi (admitted pro
`
`hac vice) to appear at the oral hearing without lead counsel present.
`
`
`
`Petitioner has conferred with Patent Owner’s counsel, and Patent Owner
`
`does not oppose this motion.
`
`II.
`
`STATEMENT OF REASONS FOR SUBSTITUTION OF COUNSEL
`
`Petitioner wishes for current first back-up counsel William P. Rothwell
`
`(Registration No. 72,522) to serve as lead counsel and current back-up counsel Mr.
`
`Noroozi of NOROOZI P.C. to remain and be the only representatives for Petitioners
`
`going forward in this proceeding.
`
`
`
`Mr. Rothwell and Mr. Noroozi meet the requirements of 37 C.F.R. § 42.10(c),
`
`so no substitution of counsel is necessary.
`
`It is believed that granting this Motion will not hinder the economy, the
`
`integrity of the patent system, the efficient administration of the Office, or the ability
`
`of the Office to timely complete this proceeding. See 35 U.S.C. § 316(b).
