`5. RESPONSE TO THE REJECTION OF CLAIMS 1-4. 8-12. 15-26. 33. 34. 36 AND 38
`
`AS ANTICIPATED BY HON '494 (GROUND 1)
`
`A. The Run-Through Atomizing Chamber
`
`Claims 1 and 10 both include a run-through atomizing chamber. The run-through
`
`atomizing chamber is described at Col 6, lines 15-16 which read:
`
`"The body of the porous component (82) has a run-through atomizing chamber
`
`(811)."
`
`The run-through atomizing chamber is further explained at Col. 8, lines 43-45 which
`
`read:
`
`"On the surface of the fixed plate (84 ), there is a mandril (842), whose front end
`
`lies against one end of the porous component (81 ), so that the fixed plate (84) is
`
`separated from the atomizing chamber (811) of the porous component (81 ). As a result,
`
`the run-through hole on one end of the atomizing chamber (811) won't be blocked, and
`
`the mist generated in the atomizing chamber (811) can be dispersed." (emphasis
`
`added).
`
`Fig. 16 shows one example of the run-through atomizing chamber.

`

`As shown, the cavity or cylindrical passageway (at 83) extends entirely through
`
`component 8, in a straight line. Both ends of the cylindrical passageway are open, so
`
`that the "atomizing chamber 811 won't be blocked." Flow through the run-through
`
`chamber is largely unrestricted. As disclosed in the 944 patent, additional elements
`
`such as plate 84 may be positioned upstream of the atomizing chamber 811, without
`
`blocking air flow through the atomizing chamber 811. The pressure drop through the
`
`run-through atomizing chamber (or its resistance to flow) may be reduced in comparison
`
`to the other flow restrictions through the electronic cigarette resulting from the geometry
`
`of its components, as shown in Fig. 1 of the 944 patent.
`
`Page 5 of the Office Action cites to a run-through atomizing chamber in Hon '494
`
`as follows:
`
`"the atomizer assembly includes an atomizer comprising an electric heating rod
`
`25, 26 and a run-through atomizing chamber (open area 1 O);"
`
`However, in Hon '494, element 25 is the atomizing chamber wall and element 26
`
`(RL) is the heating member. Relevant figures from Hon '494 are shown below.

`The open area 10 is not open at the back As shown in Figs 6 and 8 it is largely closed

`
`provided with the Office Action, which reads:
`
`"It has the jet orifice just to open one side of heating member 26, and the jet

`
`atomization cavity wall 25 is surrounded with the porous body 27, which can be made of
`
`foam nickel, stainless steel fiber felt, high molecule polymer foam and foam ceramic."
`
`Hon '494 describes vapor moving out of the atomizing chamber at the last three
`
`lines of page 5 of the machine translation as follows:
`
`" ... the suspension of minor diameter droplet in the air current formation aerosol
`
`through fog vapour passageway 12, air guide hole 17, suction nozzle 15 by the suction
`
`36 contacts of arch on liquid porous body 28 ... "
`
`The corresponding text from US 2007/0267031 is
`
`" ... the droplets with small diameter float in stream and forms aerosols, which are
`
`sucked out via the aerosol passage 12, gas vent 17 and mouthpiece 15."
`
`In Hon '494 the front of the atomizing chamber (closest to the mouthpiece)
`
`necessarily has an opening, to allow the vapor to flow out. Element 36 in Fig. 6 above
`
`from Hon '494 is an "arch". The vapor flows out around the arch as shown in the
`
`construct below.

`the present invention, in which the ultrasonic atomization high frequency generator and

`the piezoelectric ceramic element 20 are omitted. To achieve a desirable atomization
`

`
`the maximum diameters of one or more vaporization cavities formed between the
`
`heating wire and the inner wall of the nozzle range from 0.02 mm to 0.6 mm."
`
`Other vaporization nozzle designs are shown at 117, 217 and 317 in Figs. 7-9, of
`
`Hon '955.
`
`Hon '955 discloses a vaporization nozzle, not a run-through chamber. The
`
`difference is that in contrast to the claimed run-through chamber, no air flows into or
`
`through the nozzle of Hon '955. Rather, in Hon '955 liquid is pumped into the nozzle 17
`
`and is heated to create vapor. The vapor moves out of the front end of the nozzle into
`
`the mouthpiece and is entrained in air drawn into the mouthpiece through air inlets 16.
`
`This is shown in the annotated Fig. 1 below.

`
`Even if the nozzle in Hon '955 is viewed as a chamber, it is not a run-through
`
`chamber as it has no rear opening. Nothing runs through it. Liquid enters and vapor
`
`exits, but no air runs through it. There is also no negative pressure cavity in the nozzle.
`
`To the contrary, the pressure in the nozzle is positive. Liquid is pumped into the back
`
`end of the nozzle and is boiled or vaporized within the nozzle. Since the volume of the
`
`vapor is much greater than the volume of liquid, the pressure in the nozzle is positive.
`
`Hon '955 also does not disclose an electric heating rod comprising a cylinder,
`
`with the electric heating rod in an atomizing chamber. Even if the nozzle 17 in Hon '955
`
`is viewed as an electric heating rod comprising a cylinder, there is no electric heating
`
`rod lo_an atomizing chamber, because the nozzle 17 then forms or defines the chamber.
`
`The nozzle 17 cannot both form the chamber and also be in the chamber.

`Neither Hon '494 nor Hon '955 suggest a run-through chamber or the electric
