`I, Daniel N. Yannuzzi, declare as follows:

`I am an attorney of record in the above entitled Inter Partes Review

`proceedings representing Patent Owner, Legend3D, Inc. against Petitioner, Prime
`
`Focus Creative Services Canada Inc. Having been warned that willful false
`
`statements and the like are punishable by fine or imprisonment, or both, under 18
`
`U.S.C. § 1001, I declare that all statements made in this declaration based on my
`
`personal knowledge are true and all statements made on information and belief are
`
`believed to be true.

`On March 27, 2017, Patent Owner attempted to file a motion to
`
`amend in the above-captioned matter.

`Patent Owner believed the motion had been successfully filed. In

`particular, Patent Owner has not received a notice of deficiency from the Board

`relating to its motion to amend.

`Patent Owner served its motion on counsel for the Petitioner on

`March 27, 2017.

`Counsel for Petitioner and counsel for Patent Owner have met and

`conferred on the issue and the Petitioner does not oppose the re-filing of this

`motion.
