`IPR2016-01187 Petitioner request for authorization to file a Motion to Correct
`
`Dear Board:
`
`Pursuant to 37 C.F.R. § 42.20(b), Petitioner requests authorization to file a Motion to Correct under 37 C.F.R. § 42.104.
`Due to a clerical mistake, Petitioner’s original Petition, as filed, fails to properly identify a real party-in-
`interest. However, that party was known to counsel of both parties before the filing date of the Petition, the party was
`identified in the Petition in the section following the real party-in-interest section, and omission of the party was clearly
`a clerical error and was not done in any way to hide such party from the Patent Owner. In fact, the Patent Owner
`previously sued that party for patent infringement in November of 2015 for the patent at issue in the
`Petition. Petitioner therefore seeks to correct this clerical mistake via the proposed motion.
`
`Counsel for Petitioner has conferred with counsel for Patent Owner, and the Patent Owner opposes Petitioner’s Motion
`to Correct.
