`The present application is being examined under the pre-AIA first to invent

`provisions.

`Claim Rejections - 35 USC§ 103
`

`The following is a quotation of pre-AIA 35 U.S.C. 103(a) which forms the basis
`
`for all obviousness rejections set forth in this Office action:
`
`(a) A patent may not be obtained though the invention is not identically disclosed or described
`as set forth in section 102 of this title, if the differences between the subject matter sought to
`be patented and the prior art are such that the subject matter as a whole would have been
`obvious at the time the invention was made to a person having ordinary skill in the art to which
`said subject matter pertains. Patentability shall not be negatived by the manner in which the
`invention was made.

`Claims 1-5 are rejected under pre-AIA 35 U.S.C. 103(a) as being unpatentable
`
`over Burdalski et al. (2007/0069663) in view of Handschy (2006/0103913).
`
`Claim 1, Burdalski discloses an AC-driven LED assembly comprising: at least a
`
`first and a second LED each discretely packaged (see fig. 13 and P[0048]). Burdalski
`
`does not expressly discloses an AC-driven LED assembly comprising: each LED
`
`package being mounted to a substrate at a distance from the other of preferably
`
`approximately 3 mm or less, and more preferably 2.0 mm or less.
`
`However, Handchy discloses a LED assembly comprising: each LED package
`
`being mounted to a substrate (see P[001 O]) at a distance from the other of preferably
`
`approximately 3 mm or less and more preferably 2.0 mm or less (see fig . 3 and ... less
`
`than 3 mm ... , P[0042]).
`
`It would have been obvious to one of ordinary skill in the art to combine
`
`Hanschy's spacing of the diodes and Burdalski's diode AC-driven LED assembly in
`
`order to control a spacing of an image area view by a human eye.

`Claim 2, Handchy discloses the AC-driven LED assembly according to claim 1

`wherein the packaged LEDs each have a length of preferably approximately 2.5 mm or

`Claim 3, Handchy discloses the AC-driven LED assembly according to claim 1

`wherein the packaged LEDs each have a width of preferably approximately 2.5 mm or
`
`less, and more preferably 2.0 mm or less (see fig . 3 and .... 25 mm ... , [0043]).

`Claim 4, Handchy discloses the AC-driven LED assembly according to claim 1
`
`wherein the LED packages are arranged with respect to each other in a linear spatial
`
`relationship (row, P[0041 ]).

`Claim 5, Handchy discloses the AC-driven LED assembly according to claim 1

`wherein the LED packages are arranged with respect to each other in an XY rectilinear
`
`spatial relationship (array, P[0041 ]).
