` scope of petitioner's reply. Patent owner, would
` you like to begin.
` MR. WONG: Of course. Yes. Thank you,
` Your Honor. First of all, we'd like to thank Judge
` Green, Judge Pollock, Judge Harlow for being
` available on short notice to discuss this with us,
` and we also like to thank Mr. Kochanski and Mr. Van
` Buskirk for speaking to us earlier and being
` available for this conference call.
` So Your Honors, it actually is my
` pleasure to note that we actually had an opportunity
` to speak again with the petitioner's counsel, and we
` made a proposal for how to submit these issues
` vis-a-vis our concern of new arguments and the
` reply, and I believe that we've come to an agreement
` as to how to do that, but of course we want to
` present that to you and see if this is the way you
` would like to proceed or if you'd like to proceed in
` a different way.
` In addition to that, if you have
` additional questions regarding what new arguments or
` any of the issues in the matter, we're happy to
` discuss that as well, but I'm happy to start with

` what we've discussed and what we've agreed upon.
` JUDGE GREEN: I would like to know what
` you agreed upon. Yes.
` MR. WONG: Okay. So what we had
` discussed was a procedure that we've seen used in
` other IPRs with regard to concerns for new arguments
` and replies, and that was a short paper which
` includes an identification of those new arguments by
` page number and/or paragraph number, whichever is
` much -- whichever is more specific -- short
` description.
` And what we discussed with the
` petition -- the counsel for petitioner -- was that
` we would limit that to two sentences in which we
` would describe or at least put in context why we
` believe that is a new argument, and then in turn we
` would allow for the counsel for petitioner to file a
` similar document, again similarly limited to two
` sentences.
` JUDGE GREEN: So petitioner will be
` filing a similar argument to show where it was in
` the original petition or to just point out why it's
` not -- or where they're responding to something and
` -- I guess I'm not sure what petitioner is going to
` be filing.
