`Alcatel filed the above-captioned Petition for Waiver ("Petition") of the out-of-band signal

`power limitations contained in Section 68.308(e)(1) of the Commission's rules 3 so that it
`
`is a wholly-owned subsidiary of Alcatel, N.V., one of the world's largest

`telecommunications equipment, including high-speed data modems. Alcatel' s equipment is
`used for a wide range of services, including short, medium and long-haul voice, video and
`data transmission.
`Its customers include all the Bell Operating Companies, most major
`independent telephone companies, competitive local exchange carriers,
`interexchange
`carriers, cellular operators, power and other utility companies, oil companies, railroads,
`industrial companies, and state and local government agencies.

`3ln Section 68.308(e)(1) of its rules, the Commission sets forth power limitations to protect
`the public switched telephone network ("PSTN") from crosstalk and other interference
`caused by excessive analog signal power into the PSTN. These limits, which apply to
`signals in the 4 kHz to 6 MHz frequency range, are intended to ensure that signals
`transmitted from terminal equipment above voiceband (i.e., above 4 kHz) do not interfere
`with telephone company transmission systems or services that operate in that range. 4 7

`may register its Model 1000 ADSL modem equipment under Part 68.4 Alcatel, by itsattorney, hereby replies to the comments filed concerning the Petition.52.Alcatel’s Petition is limited to requesting waiver of Section 68.308(e)(l) out-of-band signal limitations.Under prior Commission decisions, such a waiver will be grantedif the petitioner demonstrates that the public interest would be served and that, based uponindustry technical standards, no harm to the PSTN would result.’3.Alcatel made this showing.Its Model 1000 ADSL modem offers businessand residential consumers an innovative, competitively priced opportunity to exploit thebenefits of the Internet and other broadband services.By now, over 140,000 of thesemodems are providing such high-speed capacity as part of numerous carrier networkofferings. The Model 1000 ADSL modem satisfies the widely accepted industry standard,established by the Committee Tl Standards Developing Organization (“SDO”), to preventcrosstalk and other interference (i.e., ANSI T1.413-1998, Sections 7.14 and 7.15 -- criteriafor out-of-band operations).These modems already have been widely installed byincumbent local exchange and other carriers in their networks without causing any harmfulinterference.4As will be documented in its Form 730, Alcatel’s Model 1000 ADSL modem otherwisemeets all Part 68 requirements for registration.Reply comments are due December 3, 1999. `4.Support for grant of the Petition is nearly unanimous. Lucent Technologies,Inc. asserts that such action clearly would be in the public interest.’ Similarly, Bell Atlanticadvocates grant of the Petition, provided that it is conditioned on meeting certainrequirements to prevent crosstalk interference.*Alcatel does not object to Bell Atlantic’srequest because it still must demonstrate compliance with these conditions when the Form730 registration application for the Model1000 ADSL modem is filed. Finally, TIA TR41.9received an anonymous email expressingcertain concerns over the methodology Alcatelused to demonstrate compliance with therequisite ANSI T1.413-1998 industry standard.gThis email has been included in the record of this proceeding notwithstanding TIA TR41.9’sreported effort to have it retracted. Nevertheless, in Appendix A hereto, Alcatel addressesthe concerns expressed in this email.5.The record of this proceeding clearly supports granting Alcatel’s requestedwaiver of Section 68.308(e)(l) for the Model 1000 ADSL modem.It is in the publicinterest because the attendant high-speed technology application to the telephone loopplant permits the wide spread deployment of broadband services to the general public andspecifically to the residential user.Empirical evidence from the nearly 140,000 deployed‘Comments of Lucent Technologies, Inc. at 1.*Comments of Bell Atlantic at l-2. These conditions are that Alcatel’s Model 1000 ADSLmodem: (1) must meet the ADSL upstream power density mask and steady-state transmitpower limits in ANSI Tl.413; (2) must meet a minimum 35 dB transverse balancerequirement across the ADSL frequency band; and (3) may be used only on ADSL-qualifiedloops. jr& at 2.‘This email has been included in the record of this proceeding. The concerns expressedtherein are that Alcatel’s methodology contained measurement uncertainty, inappropriatecorrection factors, no Sliding Window data, an incorrect PSD limit, and questionablemeasurement precision (see Appendix A).

`Appendix A - Reply to TIA TR41.9/00-02-003 - Anonymous ContributionAlcatel addresses herein some of the issues raised in the anonymous contribution that wasreceived on 1 1 /19/99 by Ahn Wride, Chair of TIA TR 41.9. This contribution subsequentlywas posted to the TIA website and distributed to the members of that committee and thenincluded in the record of this proceeding (NSD-L-99-81) on November 22, 1999, by CharlesKeller, Chief, Network Services Division, Common Carrier Bureau.Alcatel’s response to the content of this anonymous contribution is set forth below:1)Claim Regarding Measurement Uncertainty: While the common industry method isto test using a transmitter terminated with a 100 ohm resistor or a balun to match thespectrum analyzer with the line, the set-up presented in the Petition consists of a complexarrangement of multiple elements (i.e.,6 baluns, 3 Pads, and 2 power splitters). All theseelements add incremental losses, some varying with frequency. Correction factors thataccount for these elements should be noted and explained. In general, the method oftesting without a companion device will yield more accurate results because it eliminatesthe effects of the ATU-C.Alcatel Response:Alcatel, at the time of the test, wanted to use a setup which represents a typicalinstallation of the ATU-R that included the ATU-C. This approach allowed the two ends toproperly synchronize and enter the proper operating state.Alcatel’s statement regardingthe claim concerning correction factors is set forth in the response to claim 2, below.2)Claim Regarding Correction Factor:Alcatel provides no documentation orexplanation to support the 12 dB “correction factor” noted on some of the plots.Conversely, the plot for Medley is noted as not having a correction factor even though a 6dB pad is shown in the connection diagram.Where correction factors have beenmentioned, the limit line or test data have not been scaled accordingly. Thus, in somecases, the graphs infer more margin than is really the case.Alcatel Response:The 12 dB correction factor can be determined by noting the insertion loss of the powersplitters. Specifically, port 3 and port 4 have a 6 dB insertion loss which is flat over themeasurement frequencies.This results in a total 12 dB loss and is the “correction factor”noted on the appropriate plots.The 6 dB pad in the diagram for Medley and Reverb tests should be included only in thevoice band tests. The LPF insertion loss sums to 2 dB over the voice band, and thus, thetotal correction factor is 8 dB. The 6 dB pad and LPF are not included in tests other thanthe voice band tests.

`3)Claim Regarding No Sliding Window data:ANSI T1.413-1998 specifies a slidingwindow requirement of -50 dl3m maximum power in any 1 MHz sliding window above1630 kHz. These measurement data are absent from the Petition.Alcatel Response:The 1 MHz sliding window power measurement can be determined from additional plotsincluded on new Figures 4.15b, 5.4b and 5.7b, which immediately follow. The averageacross a 1 MHz sliding window accurately can be approximated from these graphs by usinga 1 MHz bandwidth and the maximum power in any 1 MHz bandwidth (along with anyassociated correction factor).A maximum can be determined by using the maximummeasured (corrected) power and adding 60 dB (correction for 1 MHz sliding window).4)Claim Regarding Incorrect PSD Limit:Alcatel specifies the PSD limit as piece-wiselinear on a logarithmic scale or a curved line on a linear scale. It appears that the Petitionincorrectly denotes the limit as a straight line on a linear scale, resulting in an inaccuratelimit specification.Alcatel Response:The limits on the graphs have been redrawn and attached where appropriate. It should benoted that the test results were unaffected as the results were below the limit in all cases.5)Claim Regarding Questionable Measurement Precision: The sweep time of 32.88ms during Medley and Reverb and 2.8 seconds during Showtime cast doubts on Alcatel’smeasurement precision. As a comparison, the balloted Spectrum Management Standardrequires an averaging time of 2 seconds per 10 kHz sample.The measurements aspresented in the Petition should have had sweep times in excess of 2000 seconds.Alcatel Response:By using the shorter sweep time, the results presented in the Petition reflect a morestringent measurement. The varying nature of the PSD over time produces peaks in thePSD which are evident in the shorter sweep times, but are averaged-out over the longersweep times. Thus, the results in the Petition are a worst-case. A longer sweep time onlywill result in “better” averaging and, thus, even better results.2
