`
`
`DECLARATION OF LAWRENCE M. HADLEY, ESQ.
`
`
`
`
`
`

`
`

`

` I, Lawrence M. Hadley, Esq., declare as follows;
`
`
`Case IPR2016-00908
`Patent No. 5,796,183
`
`
`
`1.
`
`I am an attorney and partner in the law firm of Glaser Weil Fink
`
`Howard Avchen & Shapiro LLP, located at 10250 Constellation Blvd., 19th Floor,
`
`Los Angeles, CA 90067. I am over the age of 18. I make this declaration from
`
`personal knowledge, in support of Patent Owner UUSI, LLC d/b/a Nartron’s
`
`(“Nartron’s”) motion for my admission pro hac vice in this proceeding.
`
`2.
`
`I am an attorney licensed and admitted to practice in the State of
`
`California, where I have been admitted since 1992. I am a member in good
`
`standing of the California State Bar.
`
`3.
`
`I have never been suspended, disbarred, sanctioned or cited for
`
`contempt by any court or administrative body.
`
`4.
`
`I have never had a court or administrative body deny my application
`
`for admission to practice.
`
`5.
`
`I have read and agree to be subject to the Office Patent Trial Practice
`
`Guide and the Board’s Rules of Practice for Trials set forth in part 42 of 37 C.F.R.
`
`6.
`
`I agree to be subject to the United States Patent and Trademark

`
`and I submit to disciplinary jurisdiction under 37 C.F.R. § 11.19(a).
`
`7.
`
`I have applied to appear pro hac vice in the following proceedings
`
`before the U.S. Patent and Trademark Office (“USPTO”) in the last three years:

`
`8.
`
`In each of the cases listed above, my motion for admission pro hac
`
`vice was granted.
`
`9.
`
`I practice in the field of intellectual property law, including patent
`
`litigation, and have done so for over twenty-five (25) years.
`
`10.
`
`I am admitted to practice before all state courts in California, the U.S.
`
`Supreme Court, the Courts of Appeal for the Ninth and Federal Circuits, the United
`
`States International Trade Commission, and numerous federal district courts across
`
`the country, including all federal district courts in California.
`
`11.
`
`I have extensive experience in litigating patent matters. I have been
`
`1703619
`
`

`

`litigating patent cases since 1993, and have served as lead trial counsel in dozens
`
`
`Case IPR2016-00908
`Patent No. 5,796,183
`
`
`
`of patent infringement cases. I have argued more than ten appeals of patent cases at
`
`the Federal Circuit, including appeals of IPR Final Written Decisions.
`
`12.
`
`I am intimately familiar with the subject matter of this proceeding and
`
`the patent at issue therein, U.S. Pat. No. 5,796,183 (“the ’183 patent.”)
`
`13.
`
`I was lead counsel for Nartron in Petitioner’s appeal from the Board’s
`
`prior Final Written Decision in this IPR, Paper No. 35. That appeal was captioned
`
`Samsung v. UUSI, LLC d/b/a Nartron, AIA Review No. IPR2016-00908, CAFC
`
`Case No. 2018-1310. As lead counsel, I was responsible for preparing Nartron’s
`
`arguments, drafting its briefs, and making its oral argument to the Federal Circuit.
`
`14.
`
`I am also lead trial counsel for Nartron in several district court
`
`litigations involving the ‘183 patent. I am lead trial counsel for Nartron in a district
`
`court action against Petitioner Samsung, captioned UUSI, LLC, d/b/a Nartron v.
`
`Samsung Electronics Co., Ltd., Case No. 1:15-cv-00146-JTN (W.D. Mich.), in
`
`which Nartron asserts that Samsung has infringed the ‘183 patent. I am also lead
`
`trial counsel for Nartron in a district court action against Apple, captioned UUSI,
`
`LLC, d/b/a Nartron v. Apple Inc., Case No. 18-cv-04637- JD (N.D. Cal.), in which
`
`Nartron asserts that Apple has infringed the ‘183 patent.
`
`15.
`
`I have been admitted pro hac vice to represent Nartron in six other
`
`IPRs involving the ‘183 patent, all filed by Apple: i.e., IPR2019-00355, IPR2019-
`
`1703619
`
`

`

`00356, IPR02019-00357, IPR2019-00358, IPR2019-00359, and IPR2019-00360.
`
`
`Case IPR2016-00908
`Patent No. 5,796,183
`
`
`
`16. As lead counsel for Nartron in the prior appeal, lead trial counsel for
`
`Nartron in the district court litigations, and pro hac vice counsel for Nartron in the
`
`other six IPRs, I have become highly familiar with the ‘183 patent, the invention
`
`claimed in the ‘183 patent, the technology relevant to the ‘183 patent, the
`
`prosecution history of the ‘183 patent (including the history of two separate
`
`reexaminations of the ‘183 patent), the prior art to the ‘183 patent, various court
`
`and Board decisions concerning the ‘183 patent, and various arguments which
`
`have been made concerning the validity of the ‘183 patent.
`
`17.
`
`In view of my extensive familiarity with the subject matter of this
`
`proceeding, and my more than twenty-five years of experience litigating patent
`
`cases, I believe I am fully qualified to represent Nartron in this case.
`
`18. Nartron’s lead counsel, Stephen Underwood, is a registered patent
`
`practitioner. His Registration Number is 77,977.
`
` declare under penalty of perjury under the laws of the United States of
`
` I
`
`America that the foregoing is true and correct.
