`I, Thomas H. Cormen, hereby declare and state the following:

`I am a Professor in the Department of Computer Science at Dartmouth
`
`College and was chair of the Department of Computer Science from July 2009-
`
`July 2015.
`

`
`For several years in the late 1990s, the Association for Computing
`
`Machinery (ACM) co—sponsored a workshop entitled Workshop on I/O in Parallel
`
`and Distributed Systems, or “IOPADS,” for short.
`
`3.
`
`In 1997, I was Co-General Chair of the IOPADS workshop, which
`
`was held in San Jose, California. The IOPADS 97 workshop was attended by
`
`many leading professionals and academics from the field of computer science.
`
`The IOPADS 97 workshop was open to anyone in the computer science
`
`community who wanted to register. According to my records, approximately 97
`
`computer science professionals attended the IOPADS 97 workshop.
`

`
`At the IOPADS 97 workshop, numerous professionals and academics
`
`from the field of computer science presented papers whose subjects were related
`
`to parallel and distributed systems. The proceedings of the conference, i.e., the
`
`papers that were presented, were published by ACM in a single Volume titled
`
`“Proceedings of the Fifth Workshop on 1/0 in Parallel and Distributed Systems”
`
`(“IOPADS 97 Conference Proceedings Publication”). The IOPADS 97
`
`Conference Proceedings Publication was distributed to all attendees at the

`IOPADS 1997 workshop. The IOPADS 97 Conference Proceedings were
`
`available to and accessible by members of the interested public in 1997.
`
`5. While attending the IOPADS 97 workshop, I obtained a copy of the
`
`IOPADS 97 Conference Proceedings Publication, which I have retained in my
`
`possession.
`

`One of the papers that was presented at IOPADS 97 and published in
`
`the volume distributed to conference attendees was authored by Randal C. Burns
`
`and Darrell D.E. Long, entitled “Efficient Distributed Backup with Delta
`
`Compression” (“Burns Publication”). 1 have reviewed Exhibit 1007, which is a
`
`photocopy of the Burns Publication, and is the same one published in the IOPADS
`
`97 Conference Proceedings Publication which was distributed to all attendees to
`
`the IOPADS 1997 workshop.

`At the bottom of the first column of the Burns Publication, there are
`
`two lines of text indicatingthe year of publication, which are consistent with my
`
`understanding and recollection that the Burns Publication was available to
`
`members of the public in 1997. First, the Burns Publication says “Copyright
`
`1997.” Second, the Burns Publication says “IOPADS 97 San Jose CA USA,”
`
`which, again, is consistent with my recollection and understanding that the Burns
`
`Publication was included in the IOPADS 97 Conference Proceedings Publication.

`I understand that this declaration will be filed as evidence in a
`
`Cases IPR2016-00850, IPR201 6-0085]
`
`Patent 6, 6 71, 75 7
`
`contested case before the Patent Trial and Appeal Board of the United States Patent
`
`and Trademark Office.
`
`I also understand that I may be subject to cross-
`
`examination concerning this declaration, and I will appear for cross-examination, if
`
`required of me, during the time allotted for cross-examination.

`I hereby declare that all of the statements made herein of my own
`
`knowledge are true and that all statements made on information and belief are
`
`believed to be true; and further that these statements were made with knowledge
