`Having considered the Stipulation of Dismissal of Entire Action with
`Prejudice filed jointly by the parties on August 30, 2010 pursuant to Federal Rule
`of Civil Procedure 41(a)(1),
`IT IS HEREBY ORDERED THAT:
`1. The above-captioned action (including without limitation all claims and
`counterclaims asserted in the action) is dismissed in its entirety with prejudice.
`2. All pending motions are deemed withdrawn and moot.
`3. Each party shall bear its own legal expenses, including without
`limitation, attorneys’ fees and costs.
