`In the Scheduling Order dated June 27, 2016, the Board encouraged the
`
`
`
`parties to discuss alternative means for resolving the dispute regarding the subject
`
`matter of this proceeding.
`
`
`
`As encouraged by the Board, Petitioner’s counsel contacted Patent Owner’s
`
`counsel on August 17, 2016 and discussed the possibility of alternative means for
`
`resolving this dispute. On August 18, 2016, Patent Owner’s and Petitioner’s
`
`counsel conferred and agreed that there were no additional terms to discuss that
`
`would resolve this dispute, in light of Patent Owner’s and Petitioner’s
`
`March 2, 2016 formal mediation before the United States District Court of the
`
`Eastern District of Texas with respect to a pending litigation involving the
`
`instituted claims.

`
`To date the parties have not reached any agreement to resolve the dispute.
`
