`
`·1· · · · UNIDENTIFIED SPEAKER:· Nonpracticing entities or
`
`·2· ·NPEs are businesses that make money by asserting patents
`
`·3· ·against companies that sell products and services.· NPEs
`
`·4· ·usually sued dozens of companies of all sizes and rely
`
`·5· ·on many of them settling without a fight.· The patents
`
`·6· ·used in these litigations are often invalid and
`
`·7· ·shouldn't be asserted against anyone.· In fact, when
`
`·8· ·patents in litigation have been challenged at the patent
`
`·9· ·office, 89 percent had at least one invalid claim and
`
`10· ·60 percent were completely invalid.
`
`11· · · · · · ·In the past a company's only option was to
`
`12· ·fight an NPE in court or settle.· Unfortunately, the
`
`13· ·average cost to fight can be over the millions even when
`
`14· ·a company successfully demonstrates that a patent is
`
`15· ·invalid.
`
`16· · · · · · ·Because of the high cost of fighting, almost
`
`17· ·all companies settle.· In fact, 50 percent do so in the
`
`18· ·first 6 months of litigation long before a Court
`
`19· ·determines if a patent is actually valid.· These initial
`
`20· ·settlements fund NPE litigation against the remaining
`
`21· ·companies, and they incentivize other NPEs to bring more
`
`22· ·suits resulting in a vicious cycle of litigation and
`
`23· ·costs.· Over the last ten years, NPE litigation has
`
`24· ·risen 1500 percent and cost defendants more than
`
`2
`
`

`
`·1· ·$10 billion last year.
`
`·2· · · · · · ·Companies now have an alternative.· Unified
`
`·3· ·Patents is the only third-party solution that breaks the
`
`·4· ·cycle rather than incentivize it.· Our unique solution
`
`·5· ·protects strategic technologies from NPE activity and
`
`·6· ·does so with three goals in mind.
`
`·7· · · · · · ·First, zealously fighting invalid patents;
`
`·8· ·second, never paying NPEs a cent; and, third, deterring
`
`·9· ·future NPE activity.· Unified reduces NPE costs and
`
`10· ·forces NPEs to seek easier targets for their future
`
`11· ·activity which allows businesses to focus on making
`
`12· ·great products rather than on frivolous litigation.· On
`
`13· ·average Unified members have seen an ROI of over
`
`14· ·900 percent.
`
`15· · · · · · ·Join over 60 other member companies and allow
`
`16· ·Unified to help protect your most valuable products and
`
`17· ·services from NPEs.
