`
`PETITIONER’S REQUEST FOR REFUND OF POST-INSTITUTION FEES
`
`

`
`Case No. IPR2016-00250
`Request for Refund
`
`On November 25, 2015, Petitioners Hyundai Motor America, Inc., Hyundai
`
`Motor Company, Kia Motors Corporation and Kia Motors America,
`
`Inc.
`
`(“Petitioners”) filed a petition for inter partes review (“IPR”) challenging claims 1,
`
`3, 4, 7, 9, 11, 13, 14, 17, 19, 21, 23, 24, 27, 28, 30, 32, 33, 37, and 38 in U.S.
`
`Patent No. 8,214,097. In challenging these 20 claims, Petitioner prepaid $14,000
`
`for the post-institution fee (for up to 15 claims) and $2,000 for the 5 claims in
`
`excess of 15 ($400 for each excess claim). The parties settled their dispute and
`
`filed a joint motion to terminate this proceeding on December 22, 2015. See paper
`
`11. The Board granted the motion and terminated this proceeding pursuant to its
`
`decision on January 7, 2016. This proceeding was terminated prior to institution of
`
`trial. See paper 13.
`
`Because the IPR petition was not instituted, Petitioner respectfully requests a
`
`refund of $16,000 for the post-institution fee that was prepaid. The filing fee was
`
`paid by Deposit Account No. 02-4467. Accordingly, Petitioner requests that the
`
`amount of $16,000 be refunded to Deposit Account No. 02-4467.
`
`Date: January 28, 2016
`
`Respectfully submitted,
`
