`Statutory Double Patenting Rejection

`As previously presented, claims 4-5, 7-26, 28-40, 43-49 and 51-55 were

`provisionally rejected on the ground of statutory-type double patenting in view of claims 63-64,

`66-68, 71-87, 89-101, 105-11 and 113-117 of copending Application No. 12/500,968.
`
`Claims 63-64, 66-68, 71-87, 89-101, 105-11 and 113-117 of copending
`
`Application No. 12/500,968 have been canceled by Preliminary Amendment dated June 11,
`
`2010.
`
`In view of the cancellation of these claims in the ‘968 application, Applicant respectfully

`submits that the statutory-type double patenting rejection is overcome.
