`Petitioners write regarding Orbital’s contention in its Patent Owner Preliminary Responses, filed in IPR2015‐01258 and 
`IPR2015‐01259, that the respective IPR Petitions fail to establish the Bernhardt technical paper (Ex. 1002) as a prior art 
`printed publication.  While the Bernhardt paper in combination with the SAE International index page in Ex. 1002 shows 
`that the reference was cataloged and published by SAE in 1972, to put this issue to rest, Petitioners respectfully request 
`permission, under 37 C.F.R. § 42.5(b), to submit additional documents relating to the publication of the Bernhardt paper 
`in the 1970s.  Specifically, if authorized, Petitioners would file copies of the 1972 Inter‐Industry Emission Control (IIEC) 
`Progress Report and the 1973 SAE Transactions journal, as further evidence of the Bernhardt paper’s 
`publication.  Petitioners would also file a copy of a Cumulative Index of SAE Technical Papers published between 1965 
`and 1978, which lists the Bernhardt paper and describes how to order a copy from SAE, as evidence of the Bernhardt 
`paper’s public accessibility during the relevant period. 
`

`Patent Owner has had the opportunity to review the three documents and Patent Owner does not consent to 
`Petitioner’s request.
