`
`Background and Qualifications
`
`I am currently employed by Herrmann Ultraschalltechnik GmbH & Co. KG
`
`as Research and Development Manager - Acoustics. I have been continuously
`
`employed by Herrmann Ultraschalltechnik since April 1991, and I have held my
`
`current position since May 2010. I have been responsible for the development of
`
`new products, including ultrasonic welding equipment. My responsibilities have
`
`included the investigation of the fundamentals of ultrasonic vibrations and their
`
`interactions, the development of ultrasonic welding equipment, the implementation
`
`and support of FEM (finite element methods) including modal and dynamic
`
`simulations, and management of patent properties. My previous responsibilities at
`
`Herrmann Ultraschalltechnik included managing the development of sonotrodes
`
`and converters, developing ultrasonic welding components, managing projects for
`
`the nonwoven business unit, engineering simulations of the ultrasonic welding
`
`process, implementing FEA (finite element analysis) software for modeling
`
`sonotrodes, designing sonotrodes and optimizing their vibration behavior,
`
`designing ultrasonic converters, and verifying the implementation of ultrasonic
`
`equipment design.
`
`I was previously employed by Heidelberger Druckmaschinen AG as a test
`
`engineer for sheet fed offset printing machines.

`I attended the Hochschule Karlsruhe - Technik und Wirtschaft (Karlsruhe

`University of Applied Sciences) from 1986 to 1989 and earned a diploma in
`
`mechanical engineering.

`1 am a named inventor on a number of patents and patent applications, which
`
`are listed in Appendix A to this declaration.
`
`II.
`
`Basis for Opinions
`
`My opinions are based on my years of education, research and experience,
`
`my personal knowledge and information from my employment at Herrmann
`
`Ultraschalltechnik, and study of relevant materials. In fonning my opinions, I have
`
`considered U.S. Patent 8,702,883 (“the ‘883 Patent”), the relevant portions of the
`
`Decision of the Patent Trial and Appeal Board instituting an inter partes review of
`
`claim 6 of the ‘883 Patent, and the Declaration of Leo Klinstein in this proceeding.
`
`111. Opinions
`
`Claim 6 of the ‘883 Patent is reproduced below:
`
`Method according to any one of claims 1 to 3, characterized in
`
`that the first machining interval ends when the first target variable
`
`adopts the predetermined value or when a fourth target variable of the
`
`group Z adopts a predetermined value.

`In my opinion, a person of ordinary skill in the art of the invention of Patent
`
`No. 8,702,883 would understand the invention to be a method for controlling an
`
`ultrasonic welding process in which there are two intervals.
`
`In the first interval,
`
`one of a group of variables is held constant until a target variable reaches a
`
`predetermined value at which point the first interval ends. In the second interval,
`
`one of a second group of variables is held constant until a second target variable
`
`reaches a predetermined value at which point the second interval ends. The two
`
`target variables are different. It would be understood as part of the method that the
`
`target variables are detected in carrying out the method of the patent in order that it
`
`may be ascertained that the respective predetermined values have been reached.
`
`Claim lwould be understood as describing the invention as described.
`
`Claim 6 is dependent upon Claim 1 and would be understood by one of
`
`ordinary skill in the art of the invention to add an additional feature, namely that
`
`the first interval ends, not only when the first target variable reaches a
`
`predetermined value but also when a fourth target variable reaches a predetermined
`
`value, whichever comes first. It would be understood as part of the method that the
`
`target variables are detected in carrying out the method of the patent in order that it
`
`may be ascertained that the respective predetermined values have been reached.

`The specification describes detecting two target variables during a
`
`machining interval, such as a first target variable and a fourth target variable, and
`
`ending the machining interval when one of the two target variables adopts its
`
`predetermined value, at col. 3, lines 22-26:
`
`Obviously, it is also possible for two target variables to be detected
`
`during a machining interval, for example a first target variable and a
`
`fourth target variable of the group Z, and for the machining interval to
`
`end when one of the two target variables adopts it predetermined
`
`value.
`
`In my opinion, one of ordinary skill in the art would understand that the
`
`process claimed in claim 6 is described in the specification at col. 3, lines 22-26,
`
`because of the fact that both a “first target variable” and a “fourth target variable”
`
`are referenced in both claim 6 and in this paragraph of the specification, and a
`
`“fourth target variable” is not referenced anywhere else in the specification.
`
`In my opinion, one of ordinary skill in the art, informed by the disclosure in
`
`the specification, would understand that claim 6 requires detecting both the first
`
`target variable and the fourth target variable, and terminating the machining
`
`interval when the first of either of the two detected variables reaches its respective
`
`predetermined value.

`I understand from the Decision that the Patent Trial and Appeal Board has
`
`adopted the interim construction of claim 6, such that claim 6 would only require
`
`that a single target variable be monitored. In my opinion, one of ordinary skill in
`
`the art would consider this construction to be unreasonable, in that (1) it is
`
`nowhere disclosed in the specification, and (2) it would render the reference to the
`
`fourth variable meaningless, because both the first and forth target variables are
`
`selected from the same group. Claim 6 depends from claim 1, which requires the
`
`first target variable to be selected from the group Z. However, claim 6 expressly
`
`requires the fourth target variable to be selected from group Z as well. Thus,
`
`according to the interim construction, the machining interval ends when a target
`
`variable from group Z achieves its predetermined value. The references to “first”
`
`and “fourth” are inexplicable unless it is also understood that two different
`
`variables must be detected or monitored, as described in the specification.
`
