`
`
`On December 7, 2016, a conference call was held in these proceedings
`among counsel for LG Electronics, Inc. (“Petitioner”), counsel for CORE Wireless
`Licensing S.A.R.L. (“Patent Owner”), and Judges McKone and Cherry. The Board
`requested the call after the parties emailed the Board regarding a dispute over
`whether Petitioner could file a corrected version of Exhibit 1016, which is
`identified as the deposition transcript of Patent Owner’s declarant, Scott Denning.
`Petitioner explained that through a clerical error it had filed only excerpts of the
`deposition, that only recently it had discovered the error, and that it wished to
`correct that error because it understood that 37 C.F.R. § 42.53(f)(7) required a
`complete copy of the deposition transcript be submitted to the Board. Patent
`Owner objected because it was concerned that Petitioner was attempting to
`supplement the record improperly on the eve of the hearing.
`After a discussion with the Board, Petitioner represented to the Board that
`this was only an effort to ensure that the exhibit was in compliance with our rules
`and that Petitioner would not attempt at the hearing to cite or rely on portions of
`the deposition transcript that had not previously been cited. With those
`representations, Patent Owner agreed to waive its objections.
`We granted authorization to Petitioner for the correction, and directed
`Petitioner to file the complete copy of Mr. Denning’s deposition transcript as a
`new exhibit number to avoid any inadvertent citations to previously uncited
`portions of the deposition transcript.
`
`ORDER
`
`It is
`ORDERED that Petitioner is authorized to file, as a new exhibit number, the
`corrected version of Exhibit 1016.
