`I.
`
`INTRODUCTION
`Pursuant to 37 C.F.R. § 42.56 and as authorized by the Board in its August
`
`24, 2020 Order Granting Petitioner’s Motions to Seal (Paper 122 at 9), Petitioner
`
`RPX Corporation respectfully requests that, for the reasons set forth below, the
`
`Board expunge from the record the confidential information that the Board
`
`previously ordered sealed in this proceeding. If the Board denies in whole or in
`
`part Petitioner’s expungement request, Petitioner requests that any document(s) the
`
`Board previously ordered sealed but does not order expunged be kept confidential
`
`and separate from the files of the involved patent. The parties have conferred, and
`
`Patent Owner indicated it may oppose expungement, but Patent Owner does not
`
`oppose maintaining the record sealed and confidential.
`
`Specifically, Petitioner requests that the following documents currently
`
`under seal be expunged from the record, because these documents contain
`
`Petitioner’s highly confidential business information and because redacted versions
`
`of many of these documents were filed in the record and are currently available to
`
`the public:1

`II. APPLICABLE LEGAL STANDARDS
`A party may file a motion to expunge confidential information from the
`
`record. 37 C.F.R. § 42.56; see also Consolidated Trial Practice Guide, at 21-22
`
`(Nov. 2019). While “[t]here is an expectation that information will be made public
`
`where the existence of the information is referred to in a decision to grant or deny a
`
`request to institute a review or is identified in a final written decision following a
`
`trial,” the “rule balances the needs of the parties to submit confidential information
`
`with the public interest in maintaining a complete and understandable file history
`
`for public notice purposes.” Id. at 22. A party seeking expungement from the
`
`record must show good cause by demonstrating “that any information sought to be

`expunged constitutes confidential information, and that Petitioner's interest in
`
`expunging it outweighs the public's interest in maintaining a complete and
`
`understandable history of this inter partes review.” Atlanta Gas Light Co. v.
`
`Bennett Regulator Guards, Inc., IPR2013-00453, Paper 97 at 2 (P.T.A.B. Apr. 15,
`
`2015).
`
`III. GOOD CAUSE EXISTS FOR EXPUNGING THE CONFIDENTIAL
`DOCUMENTS
`The Board granted all six of Petitioner’s Motions to Seal, and sua sponte
`
`sealed the confidential version of the Final Decision on Remand (Paper 125; see
`
`Paper 126), thereby sealing all the documents listed in Section I of this motion.
`
`See Decisions Granting Petitioner’s Motions to Seal (Paper 53 at 11; Paper 122 at
`
`8-9). In its Decisions Granting Petitioner’s Motions to Seal, the Board found that
`
`good cause existed to seal all these documents for all of the reasons provided in the
`
`underlying motions to seal.
`
`A. Documents with Redacted Versions Available
`Redacted versions of many of the sealed documents were filed in the record
`
`and are currently available to the public. For ease of reference, the following table
`

`As the Board found in granting Petitioner’s six Motions to Seal, these
`
`confidential sealed documents contain Petitioner’s confidential and highly
`
`sensitive information, disclosure of which would adversely harm Petitioner. Paper
`
`53 at 3-9; Paper 122 at 3-7. The information reflected in the documents is
`
`confidential, sensitive commercial information, including RPX’s IPR litigation
`
`strategy, confidential agreements with a third party, communications referring to
`
`terms of those confidential agreements, sensitive and improper disclosures of the
`
`
`

`confidential information, confidential business records, as well as trade secrets.
`
`Public disclosure of Petitioner’s highly confidential business information would
`
`cause great harm to Petitioner, including “severely impact[ing] RPX’s ability to
`
`conduct business with third parties[,]… negatively impact[ing] RPX’s business
`
`relationships,” and “provid[ing] an unfair advantage to current and future litigants
`
`and other adversarial parties with whom RPX deals[,]… [thus] hamper[ing] RPX’s
`
`ability to carry out its business.” Paper 114 at 6, 9.
`
`The public interest in maintaining a complete and understandable file history
`
`for public notice purposes is adequately served by retaining only the redacted
`
`versions of the confidential documents in the record. These redacted versions
`
`“maintain the essence” of non-confidential material contained in the documents
`
`and relied upon in the Board’s Final Decision on Remand (Paper 128) and
`
`Decision Denying Petitioner’s Request for Rehearing (Paper 142). Atlanta Gas
`
`Light at 2, 3.
`
`B. Documents Sealed in Their Entirety Without Redacted Versions
`In ruling on Petitioner’s Motions to Seal, the Board found that good cause
`
`existed to seal certain documents in their entirety. As the Board found, these
`
`confidential sealed documents contain Petitioner’s confidential and highly
`
`sensitive information, disclosure of which would adversely harm Petitioner. Paper
`
`53 at 3-9; Paper 122 at 3-7. The information reflected in the documents is
`
`

`confidential, sensitive commercial information, including RPX’s IPR litigation
`
`strategy, confidential agreements with a third party, communications referring to
`
`terms of those confidential agreements, sensitive and improper disclosures of the
`
`confidential information, confidential business records, as well as trade secrets.

`Public disclosure of Petitioner’s highly confidential business information would
`
`“severely impact RPX’s ability to conduct business with third parties[,]…
`
`negatively impact RPX’s business relationships,” and “provide an unfair advantage
`
`to current and future litigants and other adversarial parties with whom RPX
`
`deals[,]… [thus] hamper[ing] RPX’s ability to carry out its business.” Paper 114 at
`
`6, 9. Further, many of the documents were produced voluntarily by Petitioner. If
`
`confidential information produced voluntarily under a protective order were to be
`
`disclosed publicly, the producing party would be discouraged from volunteering
`
`discovery of confidential information in proceedings before the Board.
`
`Of the confidential documents sealed in their entirety, the following 25
`
`documents were not cited in the Board’s decisions on remand; therefore
`
`Petitioner's interest in maintaining their confidentiality through expungement far
`
`outweighs the (nonexistent) public interest in disclosure of these documents.

`Of the above documents cited in the Board’s decisions, Ex. 1074 (RPX’s
`
`Form Membership Agreement) was relied upon in the Final Decision only to
`
`support that RPX’s business model involves securing license rights for its
`
`members, which was a fact not in dispute. Paper 128 at 12. Ex. 2022
`
`(Confidential Communications Log) was relied upon to support the Board’s
`
`
`

`finding that there is “extensive record evidence of communications between RPX
`
`and Salesforce” (Paper 128 at 29), and the Federal Circuit’s publicly-available
`
`decision already lists the relevant log items relied upon by the Board. See
`
`Applications in Internet Time, LLC v. RPX Corp., 897 F.3d 1336, 1341, 1355 (Fed.
`
`Cir. 2018). The other eight documents (Exs. 1020-1022 and 1075-1079) were
`
`cited in the Rehearing Decision in conjunction with Ex. 1074, only as evidence that
`
`“RPX’s typical membership agreements, of which Salesforce’s is included … do
`
`not include the filing of IPRs,” another fact that was not in dispute. Paper 142 at 8.
`
`Accordingly, the public’s interest is adequately served by the Board’s description
`
`of the documents in its Final Decision on Remand and Decision Denying
`
`Petitioner’s Request for Rehearing, because the relevant contents are already either
`
`described or disclosed in judgments and decisions by the Board and Federal Circuit
`
`and are also used only to support findings not in dispute.
`
`Balancing the adequately-served public interest with the aforementioned
`
`harms to Petitioner that would ensue from publicly disclosing the contents of those
`
`documents, all of the documents sealed in their entirety should be expunged from
`
`the record.
`
`IV. CONCLUSION
`For the foregoing reasons, Petitioner respectfully requests that the Board
`
`protect Petitioner’s highly confidential business information and expunge the
`
`
