`Please take notice that under 35 U.S.C. §§ 141(c), 142, 319; 37 C.F.R. §§

`90.2(a), 90.3(a), and Federal Rules of Appellate Procedure/Federal Circuit Rule
`
`4(3)(a), Petitioner Ericsson hereby appeals to the United States Court of Appeals
`
`for the Federal Circuit from the Decision Denying Request for Rehearing entered
`
`on April 28, 2017 (Paper 26) and the Final Written Decision entered on February
`
`8, 2017 (Paper 24), and all rulings leading up to those decisions.
`
`In accordance with 37 C.F.R. § 90.2(a)(3)(ii), Ericsson’s issues on appeal
`
`include at least: (i) the Board erred in finding that claims 8-12 and 18-22 are not
`
`unpatentable in view of Dulin, Zhuang, Yamaura, and Hwang; (ii) the Board erred
`
`in construing certain terms, including the term “transmit[ting] a broadcast channel
`
`in an OFDMA core-band”; and (iii) any findings or determinations supporting or
`
`related to the aforementioned issues as well as all other issues decided adversely to
`
`Ericsson in any orders, decisions, rulings, and opinions.
`
`Simultaneously with this submission Ericsson is filing a copy of this Notice
`
`of Appeal with the Director of the United States Patent and Trademark Office and
`
`a copy of the same, along with the required docketing fee, with the Clerk of the
`
`United States Court of Appeals for the Federal Circuit as set forth in the
`
`accompanying Certificate of Service.
