`
`JOINT CLAIM CONSTRUCTION CHART
`
`Pursuant to Order No. 6 and Ground Rule 8.3, Complainants BASF Corporation and
`
`UChicago Argonne LLC (collectively, “Complainants”), Respondents Umicore S.A., Umicore
`
`USA Inc., Makita Corporation, Makita Corporation of America, and Makita U.S.A. Inc.
`
`(collectively, “Respondents”), and the Commission Investigative Staff (“Staff”) (altogether, the
`
`“Parties”) by and through their undersigned counsel hereby submit their Joint Claim
`
`Construction Chart. Attachment A identifies proposed constructions for the ten disputed claim
`
`terms identified by the parties for construction. Attachment B identifies the parties’ agreed upon
`
`constructions for six terms. The proposed constructions are for claim terms from the asserted
`
`claims of United States Patent No. 6,677,082 (“the ’082 patent”) and United States Patent No.
`
`6,680,143 (“the ’143 patent”).
`
`Pursuant to Ground Rule 8.3, the Parties jointly identify the following claim terms whose
`
`construction will be most significant to the resolution of the case:
`
`1. N/A
`
`SONY EXHIBIT 1008
`
`
`
`
`In addition to the above, the Complainants identify the following additional claim terms
`
`whose construction will be most significant to the resolution of the case:
`
`2. N/A
`
`In addition to the above, the Respondents identify the following additional claim terms
`
`whose construction will be most significant to the resolution of the case:
`
`3. (a) “prepared in its initial discharged state”/”having in its initial discharged state”; (b)
`
`xLiMO2•(1-x)Li2M'O3; (c) “both the LiMO2 and Li2M’O3 components being layered”; (d)
`
`“wherein domains of the LiMO2 and Li2M'O3 components exist side by side”; (e) “domains”;
`
`and (f) “components.”
`
`In addition to the above, the Staff identifies the following additional claim terms whose
`
`construction will be most significant to the resolution of the case:
`
`4. N/A
`
`Neither Complainants nor Respondents believe that the proposed constructions are claim
`
`or case dispositive, at the present time, but notes that discovery is still ongoing and in the early
`
`stages and both Complainants and Respondents are still in the process of producing documents
`
`and information in response to Complainant’s and Respondents’ discovery requests.
`
`Further, at this time, the Staff is not aware of any claim terms whose constructions will be
`
`case or claim dispositive.
