`PixArt hereby submits its ADR Statement pursuant to the Scheduling Order
`
`(Paper 13) entered on December 16, 2015.
`

`Petitioner and Patent Owner are currently involved in an underlying
`
`litigation in which SyncPoint Imaging LLC (“SyncPoint”) has asserted the ’214
`
`patent against PixArt in SyncPoint Imaging, LLC v. Nintendo of America, Inc. et
`
`al., 2:15-cv-247 (E.D. Tex.) filed on February 20, 2015. The parties engaged in a
`
`court-ordered mediation on November 23, 2015 in Dallas, Texas, with a view
`
`toward a global settlement, including the present IPR. The mediation did not
`
`resolve the dispute. Since the mediation, the parties have made various additional
`
`attempts to resolve the dispute, with continuing involvement of the court-appointed
`
`mediator, but have not been able to reach a settlement.
`

`
`On January 7, 2016, the district court in the above-referenced matter stayed
`
`the case pending resolution of ownership of the ’214 patent before the United
`
`States Bankruptcy Court for the District of New Hampshire. At this point no
`
`further settlement negotiations are scheduled pending the Bankruptcy Court
`
`decision on ownership.
