`

`JM 1013
`
`
`
`I, Bernd Maurer, declare as follows:
`
`1.
`
`I studied Chemistry at the University of Karlsnihe and got my PhD in
`
`the field of SCR Technology.
`
`I started working for HJS in 1997 as Project Leader
`
`SCR. In 2000 I changed to PUREM, which was founded as a 50/50 Joint Venture
`
`between HJS and Daimler. First I was heading the department of SCR
`
`Development, later the department Advanced Development. In 2008 I came back
`
`to HJS. I am now working in the department Technology Development.
`
`2.
`
`I I am one ofthe co-authors of the article Georg Hiithwohl, Bernd
`
`Maurer, and Gennadi Zikorsidse, “Das SCRT—System - Die Kombination
`
`Partikelfilter mit SCR—Katalysator errnoglicht die gleichzeitige Verminderung der
`
`Partikel und NOX-Emission bei Nutzfahrzeugdieselmotoren.” (The “Hiithwohl”
`
`article.)
`
`3.
`
`The Hiithwohl article was distributed at the public conference 3.
`
`Dresdner Motorenkolloquium (“3rd Dresden Engine Colloquium”), which was
`
`held on May 20th and 21st, 1999, at the University of Applied Sciences Dresden
`
`(FH) in Dresden, Germany. The 3rd Dresden Engine Colloquium brought together
`
`participants from industry and academia to discuss recent and proposed advances
`
`in the field of engine exhaust treatment systems. More than 150 participants
`
`attended the conference, including those from major automotive manufacturers
`
`such as DaimlerChrysler AG. There were also many respected participants from
`
`
`
`academia, including Prof. A. Leipertz, fiom the University of Erlangen-Niirnberg
`
`and Prof. H. Bockhom as well as Prof. Weisweiler from the University of
`
`Karlsruhe. The conference was, accordingly, well attended by those who worked
`
`in the field of diesel engine exhaust treatment systems.
`
`4.
`
`I understood the 3rd Dresden Engine Colloquium to be open to all
`
`interested members of the public. I know of no restrictions placed on who could
`
`attend the conference. To my understanding, all interested members of the public
`
`were encouraged to register for and attend the conference.
`
`5.
`
`The organizers of the 3rd Dresden Engine Colloquium collected
`
`written articles for the oral presentations delivered at the conference. A collection
`
`of the written articles is attached as Exhibit 1 to this declaration. The cover page
`
`of Exhibit 1 states “3. Dresdner Motorenkolloquium” and the date “20.-21. Mai
`
`1999,” or May 20-21, 1999. On my own personal knowledge, this accurately
`
`reflects the dates on which the conference was held and on which the written
`
`articles were distributed. At the conference, the oral presentations occurred in a
`
`forum that was open to all interested persons. Copies of the written articles
`
`accompanying the presentations were fi-eely disseminated without restriction to all
`
`of those in attendance.
`
`6.
`
`The oral presentation accompanying the Hiithwohl article was
`
`delivered on May 21st by one of my co-authors, Dr. Georg Hiithwohl. The
`
`
`
`Hfithwohl article begins on page 129 of Exhibit 1 and ends on page 140. Copies of
`
`the Hiithwohl article were distributed without restriction to those in attendance at
`
`the conference.
`
`7.
`
`I declare that all statements made in this declaration are of my own
`
`knowledge and are true and that all statements made on information and belief are
`
`believed to be true; that these statements were made with the knowledge that
`
`willful false statements and the like so made are punishable by fine or
`
`imprisonment, or both under Section 1001 of Title 18 of the United States Code.
