`This Patent Assignment (this “ASSIGNMENT”), effective as of November

`all inventions identified therein and all continuations, continuations-in-part, reissues, divisionals
`and foreign counterparts thereof, and the right to sue, make claims, and recover damages for any
`past, present or future infringement of any of the foregoing; all of such right, title and interest to
`be held and enjoyed by ASSIGNEE to the same extent as they would have been held and
`enjoyed by ASSIGNORS had this ASSIGNMENT not been made.

`This ASSIGNMENT shall be subject to the provisions of Section 12 of the APA, mutatis
