`Patent 5,591,678
`
`
`On December 17, 2015, a conference call was held involving counsel
`
`for the respective parties and Judges Kokoski, Chagnon, and Abraham.
`
`The purpose of the call was to discuss issues related to scheduling and
`
`Petitioner’s Motion for Joinder filed in IPR2016-00209 (Paper 3).
`
`The parties indicated that they had come to an agreement regarding
`
`possible consolidated scheduling of the two cases, assuming a trial is
`
`instituted in IPR2016-00209. We informed the parties that, while the panel
`
`will be flexible to accommodate potential schedule consolidation, given
`
`Board resources and the deadline already set for rendering a Final Decision
`
`in IPR2015-01201, it was unlikely that the date for the Oral Hearing set in
`
`IPR2015-01201 (i.e., August 11, 2016) would be changed.
`
`We reminded the parties that they are free to stipulate to any changes
`
`to Due Dates 1–5 for IPR2015-01201, as set forth in the Scheduling Order
`
`(Paper 7). We also reminded the parties that Patent Owner may file the
`
`Preliminary Response in IPR2016-00209 at any time prior to the deadline set
`
`in the Notice of Filing Date Accorded (Paper 4), but that we would not
`
`change this deadline by Order. We also indicated that the due date for
`
`Patent Owner’s opposition to Petitioner’s Motion for Joinder in
`
`IPR2016-00209 would be extended to January 15, 2016.
`
`It is:
`
`ORDERED that the due date for Patent Owner’s opposition to
`
`Petitioner’s Motion for Joinder in IPR2016-00209 is set to January 15, 2016.
