` So petitioners are asking the Board

`leave to file corrected expert declarations to
`
`correct a clerical error.
`
` Petitioner's expert, Mr. Paul Beard,
`
`provided several declarations in this case in
`

`support of the petitions. And Mr. Beard understood
`
`he was providing testimony under oath, but the
`
`declarations inadvertently omitted a penalty of
`
`perjury acknowledgement required by 37 CFR 1.68. So
`
`we now seek leave to file corrected declarations but
`
`only as this penalty of perjury acknowledgement.
`
` The petitioners first became aware
`
`of this error earlier this month when patent owner
`
`objected to three of Mr. Beard's reply declarations.
`
`Mr. Beard had provided seven declarations with the
`
`original petitions, but patent owner never objected
`
`to those declarations.
`
` So patent owner objected for the
`
`first time to these three -- three of the six reply
`
`declarations, just to give you sort of the
`
`procedure. The petitioner served corrected versions
`
`of three objected-to declarations adding only that
`
`penalty of perjury acknowledgement. We served those
`
`as supplemental evidence under the rules in response
`
`to the objection.
`
` And now even though patent owner has
`
`only objected to 3 of the 13 declarations from
`

`Mr. Beard, as a matter of administrative
`
`completeness, we're seeking leave to just correct
`
`all of the declarations so that the record is
`
`complete and we have corrected versions of all of
`
`them.
`
` There's no prejudice to the patent
`
`owner here. As I mentioned, patent owner never
`
`objected to the original declarations and has only
`
`objected to three of the six reply declarations.
`
` In addition, patent owner deposed
`
`Mr. Beard back in February under oath on his seven
`
`original declarations, and they had the opportunity
`
`to question him about this issue, but they never
`
`raised it. They never raised any concern, and they
`
`also didn't raise the issue in their patent owner
`
`responses that they filed earlier this year. They
`
`raised it for the first time earlier this month.
`
` And if it's helpful, I have some
`
`case law. The Board's allowed this several times
`
`before. For example, in the case Array BioPharma
`
`versus Takeda Pharmaceutical. And that's case
`
`IPR2015-00754; the order is Paper No. 20 back in

` The Board faced pretty much
`
`precisely this issue and allowed the petitioner to
`
`file corrected versions of the declarations in order
`
`to correct this clerical error.
`
` As I said, I have additional case
`
`law if I'm helpful, but I don't want to take more of
`
`the Board's time than is necessary.
`
` JUDGE SHAW: All right. Let's hear
`
`from the patent owner's counsel now.
`
` MR. KELBER: Your Honor, this is
`
`Steve Kelber.
`
` And I have to preface these comments
`
`with perhaps an acknowledgement that counsel in
`
`three of the IPRs where the objections were not
`
`served may have a different view. And I apologize
`
`for that, Your Honor.
`
` Our view is that this is not a
`
`clerical correction. Clerical corrections, as far
`
`as I'm aware -- and I'm certain of the Takeda matter
`
`because I was counsel for Takeda in that particular
`
`decision -- are governed by Rule 104. 104(c) is
`

`clearly not applicable here, was intended to fix
`
`things in a petition. And it's provided -- they are
`
`to provide that you don't lose your petition date if
`
`you had a clerical error and you fix it.
`
` This is a substantive error,
`
`Your Honor. It changes, in our view, declarations
`
`that were mere -- are papers that attempt to be
`
`declarations, but are, in fact, hearsay into
`
`potentially competent evidence.
`
` We do have some problems with the
`
`jurat that is reflected on the three substitute
`
`declarations that were filed to us. They don't meet
`
`the standard prescribed by Rule 68. To us, they do
`
`not appear to have -- bear the required signature.
`
` In the Takeda case that Mr. Bender
`
`correctly identified and in the cases on which it
`
`was decided, including ABB and Entesh [phonetic],
`
`what became important on what the motions were
`
`decided on was the nature of the declarations that
`
`were submitted in support of the position that the
`
`error was inadvertent and clerical.
`
` Where counsel -- lead counsel for
`

`the party had control over the preparation and
`
`format of the declaration, relief was not granted;
`
`where relief where the error was due to a failure to
`
`attach a paper or to insert a phrase that had been,
`
`believed to be, and intended to be, then relief was
`
`granted.
`
` So I think it's too early to say
`
`whether relief is proper here. We need to see the
`
`evidence in support of it.
`
` I would also add, Your Honor, that
`
`this is not a simple case like Takeda because in all
`
`of these cases, there is companion litigation. And
`
`I am not litigation counsel. I believe Mr. Bender
`
`belongs to the firm that is litigation counsel.
`
` Obviously, the results of these IPRs
`
`will impact the litigation to some extent.
`
`Requirements for a declaration are different at the
`
`patent office and in District Court. And I think we
`
`can't simply agree wholesale to replacement of
`
`papers with jurats and without jurats given that if
`
`the patents should survive, these -- that matters
`
`will be, once again, considered by the District
`

` What is -- given that no motion is

`being required, what is the authority for so

`proceeding?

` JUDGE SHAW: We have discretion to

`grant evidence vary allowances. And if you have
`
`concerns about it, we can discuss further and take
`
`it under advisement. If you have any --
`
` MR. KELBER: I do have concerns
`
`about that, Your Honor. I don't think that
`
`correction of the declarations offered in support of
`
`the petition is possible at this point under the
`
`discretionary provisions referred to.
`
` And I -- I guess I would --
`
`obviously the Board has authority to do as it
`
`believes is correct, but my understanding of Rule 22
