`
`
`PETITIONER’S REQUEST FOR ORAL ARGUMENT
`
`
`
`
`

`
`Case IPR2015-01173
`U.S. Patent No. 7,329,970
`
`
`Pursuant to 37 C.F.R. § 42.70, the Board’s Scheduling Order dated
`
`November 17, 2015 (Paper 14), and the Notice of Stipulation to Extend Due Dates
`
`4-5 dated June 22, 2016 (Paper 29), Petitioner Apple Inc., Motorola Mobility LLC,
`
`and Toshiba America Information Systems, Inc. (collectively, “Petitioner”)
`
`respectfully requests oral argument on issues related to the patentability of claims
`
`1, 3-5, 10-14, 19, 48, 49, 51, and 52 of U.S. Patent No. 7,329,970 (“’970 patent”)
`
`on the instituted grounds set forth in the Board’s Decision (Paper 13) and on any
`
`issues specified in any motions to exclude or motions for observation regarding
`
`cross-examination of reply witnesses filed by the parties. The Board has
`
`previously scheduled the oral argument for August 3, 2016. (Paper 14.)
`
`The Board has also scheduled hearings in the following five related cases on
`
`the same date (August 3, 2016):
`
`• IPR2015-01171 (U.S. Patent No. 7,994,726) (“’726 patent”);
`
`• IPR2015-01172 (U.S. Patent No. 7,498,749) (“’749 patent”);
`
`• IPR2015-01174 (U.S. Patent No. 7,781,980) (“’980 patent”);
`
`• IPR2015-01175 (U.S. Patent No. 8,288,952) (“’952 patent”); and
`
`• IPR2015-01603 (U.S. Patent No. 7,498,749) (“’749 patent”).
`
`The ’726, ’749, ’970, ’980, and ’952 patents are directed to similar
`
`technologies. The six trials will therefore involve overlapping issues and
`
`arguments. Thus, Petitioner requests that the Board provide a consolidated oral

`
`argument for all six trials in which Petitioners are given two hours to present their
`
`arguments, including any time reserved for rebuttal arguments.
`
`Petitioner respectfully requests that the hearing be held in Room A, in order
`
`to accommodate the three law firms representing the three Petitioners across the
`
`six cases (Apple Inc., Motorola Mobility LLC, and Toshiba America Information
`
`Systems, Inc.) and the three law firms representing Patent Owner across the six
`
`cases, as well as client representatives who may wish to attend. Petitioner requests
`
`permission to use a computer, projector, and screen to display demonstratives and
`
`exhibits. Petitioner also requests that four attorneys at Petitioner’s counsel’s table
`
`be allowed to use computers.
