`Corporation and NEC Cmporation of America (lhe ''Parties") today announced that on August 2.
`~1 0 1 2, they signed n Patent I .iccnsc Agreement (the "Agreement"). Under the terms of the Agreement,
`VirnctX has agreed to license certain of its patents to NEC Corporation and NFC Corporation of
`t\Jnerica. for a one-lime payment to VirnetX and an ongoing reasonable royalty on future sales as
`outlined in the Agrccm<..~nl \\ith respect to certain current and Cuturc IP telephony product:; supporting
`cncryptcd communications.

`Under the terms of the AgrcclllcnL the Parties have also agreed to dismiss the patent inJringemcnl
`case brought by Virn~..~tX lx:forc the U.S. District Court l(H· the Eastern District of Texas. All other
`aspects ot' the agreement were not disclosed.
