`Pursuant to 37 C.F.R. § 42.70 and the Scheduling Order dated September 9,
`
`2015 (Paper 10), Patent Owner hereby submits that no oral argument is necessary
`
`in this proceeding.
`
`Claims 4, 8, and 9 of U.S. Patent No. 7,202,843 are at issue in this case. The
`
`identical patent and claims were also challenged in IPR2015-00021. A final
`
`written decision has recently issued in IPR2015-00021, and claims 4, 8, and 9 were
`
`determined by the Board to be unpatentable in that case.
`
`A conference call has been scheduled with the Board on April 5, 2016 by
`
`request of Patent Owner. During that call, Patent Owner will request permission to
`
`move for "appropriate" termination of this proceeding under 37 CFR 42.72. In the
`
`event that the Board denies permission to move for termination, or ultimately
`
`denies a motion to terminate, then Patent Owner respectfully submits that no oral
`
`argument is necessary in this proceeding.
