`DECLARATION OF PAUL E. BERG
`
`I, Paul E. Berg, have personal knowledge of the matters stated or referenced
`
`herein and if called to testify about them, I could and would be able to do so.
`
`1. I became involved in Universal Serial Bus (“USB”) technology in 1995 while
`working for SystemSoft Corporation where under contract to Intel, I was one
`of the authors of the original USB 1.0 Specification.
`
`2. In 1996, I became the Director of Engineering, USB Products for SystemSoft
`and the USB Device Working Group Document Review Board Secretary. My
`team at SystemSoft Corporation created one of the first prototype USB
`peripherals to be tested at a USB compliance event.
`
`3. I am currently the Program Manager for the USB Implementers Forum
`(“USB-IF”) Device Working Group (DWG).
`
`4. USB technology has been my primary focus since the USB 1.0 Specification
`was published in January 1996, and I have participated as a speaker and
`seminar leader at a number of USB-IF Developers Conferences, an Intel
`Developer Forum in Taiwan, as well as many other technical meetings.
`
`5. In addition to being a co-author of the original USB 1.0 Specification, I was a
`reviewer and contributor of work leading to the publication of the USB
`Specification Revision 1.1.
`
`6. Attached as Exhibit A is a true and correct copy of the Universal Serial Bus
`Specification Revision 1.1. Based on my experience in the development of
`USB technology, my involvement with the USB Specification Revision 1.1 and
`USB-IF, and my personal knowledge, the USB Specification Revision 1.1
`attached as Exhibit A was publicly available as of September 1998.
`
`7. I received a copy of the USB Specification Revision 1.1 through my
`involvement with the USB-IF.
`
`8. It has been a part of my regular practice in my occupation in the field of USB
`technology to keep a record of the USB Specification Revision 1.1.
`
