`On May 20, 2016, Patent Owner filed its Motion for Observations on the
`
`Case No.: IPR2015-00800

`Cross Examination of Dr. Jeffrey Stein. (“POM,” Paper 21.) Petitioner
`
`respectfully submits the following responses to each of the Patent Owner’s
`
`observations.
`
`A. Observation 1
`
`Patent Owner’s observation is not relevant because Dr. Stein’s deposition
`
`testimony is not inconsistent with his declaration testimony. On pages 6-7 of Ex.
`
`2819, Dr. Stein stated that if he were teaching his students about the factors that
`
`“contribute to the torque required to propel [] vehicles,” then he would discuss
`
`“lots of different issues,” including: “the inertia of the vehicle and, therefore, the
`
`acceleration of the vehicle . . . the acceleration of any rotating parts, friction of
`
`rotating parts, aerodynamic drag considerations, so moving the vehicle through the
`
`air, the wind, grade.” (Stein Tr., Ex. 2819 at 6:11-7:5.)
`
`This is not relevant to Dr. Stein’s cited declaration testimony, which
`
`addresses Patent Owner’s arguments to add limitations to claim 241, e.g., “the
`
`engine is brought into operation” and “a comparison of the RL to a setpoint (SP)
`
`results in a determination that.” (Reply Decl., Ex. 1889, ¶¶6-12.)
`
`Patent Owner further states that this “testimony is relevant because it calls
`
`into question Dr. Stein’s reply declaration testimony that U.S. Patent No.
`
`5,343,970 (‘the ’970 patent’) uses road load.” (POM at 1.) Here, Patent Owner
`
`
`
`

`
`appears to be re-arguing for an interpretation of “road load” that includes how
`

`“road load” is determined by importing external torque requirements, e.g., that one
`
`must separately measure/determine external “factors such as aerodynamic drag,
`
`wind, grade, and acceleration.” (POM at 1, see also POR at 51-52; Hn. Decl., Ex.
`
`2808, ¶¶135, 138.) Dr. Stein addressed this argument in paragraphs 49-50 of his
`
`reply declaration (Ex. 1889), and concluded: “This whole argument is irrelevant
`
`because the challenged claims do not require determining ‘the amount of
`
`instantaneous torque required to propel the vehicle’ based on rolling resistance or
`
`wind resistance, but not based on accelerator pedal, as argued by Mr. Hannemann.”
`
`(Reply Decl., Ex. 1889, ¶50.) In IPR2014-00875, the Board also rejected such an
`
`interpretation of “road load”:
`
`We are not persuaded by this argument because we decline to import
`
`“external torque requirements” into our interpretation of “road load,”
`
`as discussed above. See Section I.E.1.
`
`Accordingly, we are persuaded by Petitioner that “driveability torque
`
`requirement” and “total traction torque” represent the instantaneous
`
`torque required to propel the vehicle and, therefore, Vittone discloses
`
`“road load.”
`

`Further, during the Oral Hearing for IPR2014-00875, Patent Owner’s
`
`counsel admitted that the ‘347 Patent (which shares a specification with the ‘388
`

`Patent and the ‘634 Patent) does not disclose how “road load” is determined. (See
`
`Case No.: IPR2015-00801

`Oral Hearing Tr. 2015, Ex. 1900 at 41:10-19.)
`
`B. Observation 2
`
`Patent Owner’s observation is not relevant because Dr. Stein’s deposition
`
`testimony is not inconsistent with his declaration testimony. In his deposition, Dr.
`
`Stein described the challenged claims and Suga. (Stein Tr., Ex. 2819 at 12:5-16.)
`
`Dr. Stein stated that the challenged “claim” of the ‘634 Patent is directed to “sizing
`
`the electric motor, and the power performance of an electric motor, and that's what
`
`the claim is talking about for an electric vehicle.” (Stein Tr., Ex. 2819 at 12:11-14.)
`
`Then Patent Owner’s counsel asked Dr. Stein to clarify his previous answer, and
`
`Dr. Stein stated that challenged claims 291 and 266 of the ‘634 Patent are directed
`
`to a “vehicle being operated in what is often called EV mode, electric vehicle
`
`mode.” (Stein Tr., Ex. 2819 at 12:17-13:9.) Dr. Stein further stated that Suga
`
`suggests evaluating “an electric motor that's going to be used in an electric vehicle
`
`or a hybrid electric vehicle that's in electric vehicle mode to evaluate it relative to,
`
`amongst other things, driving cycles, such as the FUDS driving cycle.” (Stein Tr.,
`
`Ex. 2819 at 13:12-18.)
`
`Dr. Stein explained in paragraphs 39-45 of his Reply Declaration that
`
`“[s]ince Severinsky ’970’s HEV operates very much like an electric vehicle in low
`
`speed mode, it would have been obvious to a person of ordinary skill in the art to
`

`test Severinsky ’970’s electric motor using the electric vehicle testing apparatus
`

`disclosed in Suga to confirm that it meets the FUDs test.” (Reply Declaration, Ex.
`
`1889, ¶43; see also, Stein, Ex. 1852, ¶395.) Thus Dr. Stein’s cited deposition
`
`testimony does not contradict his Reply Declaration, as the deposition testimony
`
`refers to the electric vehicle (EV) mode limitations of the challenged claims.
