`
`
`DECISION
`Patent Owner’s Motion to Seal
`37 C.F.R. §§ 42.14 and 42.54
`
`
`
`
` Patent Owner, Paice LLC & The Abell Foundation, Inc., filed a
`motion to seal Exhibit 2902 pursuant to 37 C.F.R. § 42.14. Paper 11. Patent
`Owner represents that Petitioner, Ford Motor Company, does not oppose this
`motion.
`Exhibit 2902 is an arbitration agreement between Paice and Ford.
`
`
`
`Case IPR2015-00800
`Patent 7,237,634 B2
`
`Paice certifies that the arbitration agreement contains confidential
`information that has not been published or otherwise made publicly
`available. The issue of the arbitration agreement arose in the preliminary
`proceeding and did not arise again during the course of trial. Exhibit 2902
`was not relied on in rendering the Final Written Decision. As such,
`protecting the confidential arbitration agreement from public disclosure
`only minimally impacts the public’s interest in maintaining a complete file
`history.
`Further, Patent Owner requests that an unredacted version of its
`Preliminary Response (Paper 10) be sealed because it discusses confidential
`information from the arbitration agreement, and, therefore, should be sealed
`for the same reasons the arbitration agreement should be sealed.
`Importantly, Patent Owner filed a public version of its Preliminary Response
`(Paper 9) that redacts the confidential information.
`Based on Patent Owner’s unopposed representations and the
`reasonably limited scope of the protection sought, it is determined that
`good cause exists to grant the motion to seal. 37 C.F.R. § 42.54.
`Accordingly, it is
`ORDERED that Patent Owner’s Motion to Seal is granted; and
`FURTHER ORDERED that Paper 10 and Exhibit 2902 shall remain
`sealed.
