`On February 22, 2015, Ford Motor Company (“Petitioner”) filed a Petition
`
`Case No.: IPR2015-00785
`Attorney Docket No.: FPGP0104IPR7

`for Inter Partes Review seeking review of claims 80, 91, 92, 97, 99, 107, 108, 110,
`
`112, 114, 125, 126, 130, 132, 140, 141, 143, 145, 241, 252-254, 256-263 and 265
`
`of U.S. Patent No. 7,237,634. Patent Owner, Paice LLC & The Abell Foundation,
`
`Inc. (“PAICE, LLC”), submitted its Preliminary Response on August 10, 2015
`
`(Papers No. 9, 10). On October 26, 2015, the Patent Trial and Appeal Board
`
`issued its Judgment denying review of two (2) of the thirty-one (31) challenged
`
`claims in the Petitioner’s petition: “We decline to consider claims 99 and 132 in
`
`this proceeding.” (Paper No. 13 at p. 2)
`
`
`
`The Rules provide for a refund of the post institution excess claim fees if the
`
`Board does not institute trial. Payment of $20,400 in post-institution fees ($14,000
`
`plus $6,400 for 16 claims in excess of 15) was processed through PRPS on
`
`February 22, 2015, and charged to Deposit Account 06-1510. Petitioner hereby
`
`requests a refund of $800 for post-institution extra claim fees ($400 x 2 denied
`
`claims) under 37 C.F.R. § 42.15(a)(4).
