`EXAMINER'S AMENDMENT
`
`1 .
`
`An examiner's amendment to the record appears below. Should the changes and/or additions be
`
`unacceptable to applicant, an amendment may be filed as provided by 37 CFR 1 .312. To ensure
`
`consideration of such an amendment, it MUST be submitted no later than the payment of the issue fee.
`
`Authorization for this examiner's amendment was given in a telephone interview with Thomas
`
`Young on 1 1/24/14.
`
`The application has been amended as follows:
`
`Claim 15, line 13, "the rotational orientation" has been amended to state:
`
`-- a rotational orientation
`
`Claims 1 5-20, 22-29, 31 -33 and 35-38 are allowed.
`
`Allowable Subject Matter
`
`The following is a statement of the reasons for allowance: Regarding claim 27, upon further
`
`2.
`
`3.
`
`consideration and in view of Applicant's arguments, the rocker members of Wright are not considered
`
`"beneath" the seat undersurface, as this limitation is taken to mean vertically underneath and the rocker
`
`members of Wright are along the sides of the seat portion. Additionally, there is no teaching, suggestion,
`
`or motivation to modify the prior art of record absent hindsight.
`
`4.
`
`The remaining claims have been amended to include subject matter previously indicated as
`
`allowable. Accordingly, claims 15-20, 22-29, 31-33 and 35-38 overcome the prior art of record and are
`
`deemed allowable.
`
`Conclusion
`
`Any inquiry concerning this communication or earlier communications from the examiner should
`
`be directed to TIMOTHY J. BRINDLEY whose telephone number is (571 )270-7231 . The examiner can
