`PETITIONERS’ MOTION FOR COUNSEL TO WITHDRAW FROM THE
`PROCEEDING TO PERMIT SUBSTITUTION OF COUNSEL
`
`

`

`
`
`I.
`
`STATEMENT OF RELIEF REQUESTED
`
`Pursuant to 37 C.F.R. § 42.10(e), Petitioners Ranbaxy Laboratories Ltd. and
`
`Ranbaxy Inc. (“Petitioners”) respectfully request authorization to withdraw its current
`
`lead counsel from the present proceeding, thereby allowing Petitioners’ proposed new
`
`lead counsel and back-up counsel to promptly substitute in as counsel of record in
`
`this proceeding.
`
`The motion is unopposed by Patent Owner.
`
`II.
`
`STATEMENT OF FACTS
`
`
`
`Petitioners request that current lead counsel, Anne Elise Herold Li of Kenyon
`
`& Kenyon LLP, withdraw from the present proceeding as Ms. Li has left the firm as
`
`of January 30th, 2015. Petitioners further request the appointment of John W.
`
`Bateman of Kenyon & Kenyon LLP, as lead counsel in this proceeding. As Mr.
`
`Bateman is currently the designated back-up counsel, Petitioners additionally request
`
`the appointment of Karen C. Shen of Kenyon & Kenyon LLP as new back-up
`
`counsel in this proceeding.
`
`
`
`The rules require that a party must designate lead counsel and back-up counsel,
`
`and that counsel must be a registered practitioner. Mr. Bateman will be identified as
`
`lead counsel and is a registered practitioner (Reg. No. 41,602). Ms. Shen will be
`
`identified as back-up counsel and is a registered practitioner (Reg. No. 60,412).
`
`Petitioners are not proposing any schedule change as a result of the
`

`
`
`
`
`
`

`

`substitution. This substitution of counsel will not cause any delay in the proceeding
`
`or any prejudice to the Patent Owner.
`
`
`
`Petitioners respectfully request that the Board grant this motion for withdrawal
`
`of Petitioners’ current lead counsel. A new Power of Attorney is being filed
`
`concurrently. Upon grant of this motion, new counsel for Petitioners will promptly
`
`file Amended Mandatory Notice Information.
