`1.1
`
`Claim 1
`of
`method
`A
`activating functions
`responsive to a user
`input, comprising:
`
`ACCUSED PRODUCTS1
`The Accused Products comprise a method of activating functions responsive to a user input.
`
`For example, to the extent the preamble is limiting, the Accused Products running the Android
`operating system include at least one pre-installed e-mail application, including Email and/or Gmail,
`in which different functions are activated based on the user input. As one example, these e-mail
`applications provide a method for activating different manipulation functions based on the user input
`recognized by gestures such as long-tap and drag (for highlighting and editing), pinch and expand
`(for zooming) and dragging (for shifting the visible page area) as shown in the screenshot citations
`1.1(3)-(5).
`
`
`
`
`
`The e-mail applications, for example E-mail and Gmail, provide a method which allows a user to
`give input by selecting control tools associated with numerous control functions (examples of which
`are highlighted in screenshot 1.1(1)). For example, a control tool including control functions, such
`as “Reply” and “Forward” (among others), as shown in screenshot citations 1.1(1)-1.1(2). As
`further example, “Reply” in the control tool permits activation of the function of replying to a
`message as shown in the screenshot citation 1.1(1). In yet another example, “Forward” permits
`activation of the function of forwarding a message as shown in screenshot citation 1.1(2). Other
`control functions, such as “Delete,” “Send,” and “Compose,” among others, are also associated with
`a control tool, as shown in screenshot citations 1.1(1) and 1.1(6).
`
`See also, for example and without limitation, Sections 1.2-1.6.
`
`
`1 The Accused Products include Google’s Nexus 5, Nexus 7, Nexus 10, and any other product uncovered during discovery that is capable of responding to user
`input by activating a manipulation function when a user does not select a control tool or permitting activation of a control tool function in response to user input.

`The Accused Products include a manipulable area portion in a physical viewing area and at least one
`manipulation function associated with the manipulable area.
`
`For example the Accused Products running the Android operating system include one or more pre-
`installed e-mail applications, including Email and/or Gmail, which provides a manipulable area
`present in the physical viewing area of the screen display as shown in the screenshot citation 1.2(1).
`Multiple manipulation functions are associated with this manipulable area. As one example, long-
`tapping on the manipulable portion of the device activates functions responsible for opening up a
`context menu that allows a user to select, cut, copy, paste and various other editing actions as shown
`in screenshot citation 1.2(2). Another example of a manipulation function includes dragging on the
`screen/viewing area which changes the portion of webpage displayed, as shown in screenshot
`citation 1.2(3). As another example, the Accused Products have a pinch zoom manipulation function
`as shown in screenshot citation 1.2(4).

`ACCUSED PRODUCTS1
`The Accused Products display a representation of a control tool overlaying the manipulable area
`portion, said control tool having at least one control tool function associated therewith.
`
`For example, the Accused Products running the Android operating system include at least one pre-
`installed e-mail application, including Email and/or Gmail, which displays representations of one or
`more control tools overlaying the manipulable area portion (examples of which are highlighted in
`screenshot citation 1.3(1)), each of which are associated with at least one control tool function. For
`example, one control tool (as shown in the yellow box) overlays the manipulable area and includes
`“Reply,” which is associated with the function of replying to an original message, as shown in
`screenshot citation 1.3(1). In another example, “Forward” is included in the control tool is
`associated with the function of forwarding an original message, as shown in the screenshot citation
`1.3(2). Other control functions, such as “Delete,” “Send,” and “Compose,” among others, are also
`associated with a control tool overlaying the manipulable portion area, as shown in screenshot
`citation 1.3(3).

`
`ACCUSED PRODUCTS1
`The Accused Products comprise receiving a user input to the physical viewing area corresponding to
`the manipulable area portion and the representation of the control tool.
`
`For example, an Accused Product can receive user input when running a pre-installed e-mail
`application, such as Email and/or Gmail, when the user long taps and drags (traversing under the
`control tool) on text in the manipulable portion area as shown in screenshot citation 1.4(1). In
`another example, an Accused Product can receive user input when the user performs a dragging
`action (traversing under the control tool), on the physical viewing area corresponding to the
`manipulable area portion and the representation of the control tool as shown in screenshot citation
`1.4(2). In another example, an Accused Product can receive user input when the user when the user
`double-taps or uses pinch gestures, (traversing under the control tool), on the physical viewing area
`corresponding to the manipulable area portion and the representation of the control tool as shown in
`screenshot citation 1.4(3).
`
`As another example, an Accused Product can receive user input when the user taps on the
`representation of the control tool, and for further example, specifically “Reply”, as shown in
`screenshot citation 1.4(4). As another example, an Accused Product can receive user input when the
`user taps on the representation of the control tool, and for further example, specifically “Forward”, as
`shown in screenshot citation 1.4(5). A user can provide user input for other control tools, such as
`those associated with control functions including “Delete,” “Send,” and “Compose,” among others,
`as shown in screenshot citation 1.4(6).
`
`See also, for example and without limitation, Sections 1.2-1.3 and 1.5-1.6.

`
`ACCUSED PRODUCTS1
`The Accused Products determine if the user input selects the control tool.
`
`On information and belief, various components in the Accused Products work to determine if a user
`using a pre-installed e-application, such as Email and/or Gmail, provides user input that selects a
`control tool, including, for example, those illustrated in Sections 1.3 and 1.4.
`
`For example, when a user gives input by tapping on the control tool, and specifically tapping on
`“Reply,” the reply message drafting function associated with the control tool is permitted to be
`activated, as shown in screenshot citation 1.5(1) and which indicates that the Accused Device
`necessarily determined that the user selected the control tool. In another example, when the user taps
`on the control tool, and specifically “Forward,” the forward message drafting function associated
`with the control tool is permitted to be activated, as shown in screenshot citation 1.5(2). Conversely,
`if a manipulation function traversing under the control tool is activated, it necessarily follows that the
`control tool was not selected. See Section 1.6

`at least one control
`tool function to be
`activated when the

`input
`does

`
`
`
`ACCUSED PRODUCTS1
`The Accused Products comprise a method of activating the at least one manipulation function when
`the user input does not select the control tool or permitting the at least one control tool function to be
`activated when the user input does select the control tool.
`
`When a user using a pre-installed e-mail application, such as Email and/or Gmail, provides input in
`the physical viewing area but does not select the control tool, the input activates at least one
`manipulation function. Specifically, the user input activates the manipulation function without
`interference from the control tool, which remains inactive, even when the user input corresponding
`to the manipulation function traverses under or on the control tool. For example, long clicking and
`dragging on text in the physical viewing area corresponding to the manipulable area portion and the
`representation of the control tool activates a context based manipulation function, or a menu that has
`a set of editing and other tasks related to the text in the manipulable area, as shown in screenshot
`citation 1.6(3). In another example, user input by dragging on the physical viewing area
`corresponding to the manipulable area portion and the representation of the control tool activates the
`manipulation function of shifting the webpage contents, even when the user input drags under a
`control tool such as the reply tool, as shown in screenshot citation 1.6(4). In another example, the
`manipulation function zooming is activated when the user uses pinch gesture on the manipulable
`area portion, even when the user input pinch-gestures under a control tool such as the reply tool, as
`shown in screenshot citation 1.6(5).
`
`When a user using a pre-installed e-mail application, such as Email and/or Gmail, provides input in
`the physical viewing area that selects a control tool (including but not limited to those illustrated in
`Sections 1.3 and 1.4), at least one control tool function associated with the control tool is permitted
`to be activated. For example, when a user gives input by tapping on the control tool, and specifically
`“Reply”, the reply message drafting function is permitted to be activated, as shown in screenshot
`citation 1.6(1). In another example, tapping on “Forward” permits the forward message drafting
`function associated with the control tool to be activated, as shown in screenshot citation 1.6(2).
