`Pursuant to our October 1, 2015 Order (Paper 34),1 counsel for
`
`Petitioner sent an email communication to the Board on October 2, 2015,
`
`advising that the parties had reached an agreement to conduct the deposition
`
`of Petitioner’s new expert, Mr. Jones, during the dates of October 21–23,
`
`and had reached a tentative agreement on a new trial schedule. A proposed
`
`new trial schedule was included in the email communication. Petitioner
`
`further advised that the parties had agreed to conduct the deposition of
`
`Petitioner’s witness, Mr. Miura, on November 3–4, subject to final
`
`confirmation from Mr. Miura.
`
`On October 5, 2015, the Board sent an email communication to the
`
`parties advising that the proposed new trial schedule was acceptable.
`
`In consideration of the foregoing, it is
`
`ORDER
`
`ORDERED that Due Dates 1–5, are changed to the dates agreed upon
`
`by the parties, as reflected in the Revised Due Date Appendix below;
`
`FURTHER ORDERED that the parties’ request to extend Due Dates 6
`
`and 7 by three weeks is granted; and
`
`FURTHER ORDERED that the parties may stipulate to different
`
`dates for Due Dates 1–5 as set in the Revised Due Date Appendix.
