`On June 29, 2015, the parties filed a joint motion to terminate this
`
`inter partes review proceeding. Paper 15 (“Mot.”). In connection with their
`request to terminate, the parties filed a copy of a written settlement
`agreement, and asked that it be kept confidential under the provisions of
`35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(c). Paper 16.

`Trial in this proceeding was instituted on May 22, 2015 (Paper 11),
`and is in a preliminary stage. A patent owner response has not yet been
`filed. The parties represent they have resolved all issues relating to the
`patent challenged in this proceeding and have agreed to dismiss, with
`prejudice, the related co-pending district court litigation. Mot. 1–2
`(referencing Ex. 1018, “Confidential Settlement Agreement”). Although
`there is another inter partes review proceeding involving the challenged
`patent, IPR2015-01043, the petitioner here is not a party to that other
`proceeding. Under these circumstances, we determine that it is appropriate
`to terminate the trial in this proceeding without rendering a final written
`decision. See 37 C.F.R. § 42.72.
`Accordingly, it is
`ORDERED that the joint motion to terminate this proceeding is
`granted;
`FURTHER ORDERED that the joint request for the settlement
`agreement (Ex. 1018) to be treated as business confidential information and
`to be kept separate from the patent files, pursuant to 35 U.S.C. § 317(b) and
`37 C.F.R. § 42.74(c), is granted; and
`FURTHER ORDERED that this proceeding is hereby terminated.
