`Prior to our deciding whether to institute an inter partes review, the
`parties filed a Joint Motion to Terminate the Proceeding (Paper 8) pursuant
`to a settlement agreement, which requests that the settlement agreement
`(Paper 9) be treated as business confidential information, kept separate from
`the file of the involved patent, and made available only as proscribed under
`37 C.F.R. § 42.74(c).
`Accordingly, it is
`ORDERED that the proceeding is terminated; and
`FURTHER ORDERED that the settlement agreement (Paper 9)
`be treated as business confidential information, kept separate from the file of
`U.S. Patent No. 8,280,278 B2, and made available only to Federal
`Government agencies on written request, or to any person on a showing of
`good cause, under the provisions 37 C.F.R. § 42.74(c).
