`DECLARATION OF JODI L. GREGORY
`
`
`
`
`I, JODI L. GREGORY, hereby declare that:
`
`1.
`
`I am over the age of 21, and I have personal knowledge of the facts
`
`contained herein unless otherwise indicated.
`
`2.
`
`I am the founder and President of Access Information Services, Inc.,
`
`which provides customized business research and analyses. I have been the owner
`
`there since 1988. My duties include research and analysis, and I conduct
`
`workshops on Internet research. I am regularly engaged by a wide variety of
`
`companies to conduct research regarding the availability of scientific literature.
`
`3.
`
`From 1989 to 1994, I was also Manager of the Information &
`
`Analysis Center with UES Inc., a research, development, and technology creation
`
`and transfer company. My work duties there included creating and managing a
`
`centralized information resource center, managing research on over 200 companies
`
`and their competitors, and acquiring online databases, end-user tools, collection
`
`development systems, and database management systems.
`
`4.
`
`I have served on the Association of Independent Information
`
`Professionals’ Board of Directors, and I have held the positions of President–Elect
`
`and President of the Association.
`
`

`
`

`

`5.
`
`A true and correct copy of my Curriculum Vitae is attached hereto as
`
`Exhibit A.
`
`6.
`
`I have been asked to provide an opinion regarding the public
`
`accessibility of the references listed below:
`
`A. An Overview of the Amoeba Distributed Operating
`System, Andrew S. Tanenbaum and Sape J. Mullender.
`SIGOPS Operating Systems Review, Vol. 15, Issue 3,
`July 1981, pp. 51-64 (Ex. 1002).

`(1989). The Design of a High-Performance File Server
`(pp. 22 – 27). Presented at the 9th International
`Conference on Distributed Computing Systems, 1989,
`Newport Beach, CA: IEEE.
`doi:10.1109/ICDCS.1989.37926 (Ex. 1003)

`Systems: Amoeba and Sprite," Computing Systems, Vol.
`4, No. 4, Fall 1991, pp. 353-384 (Ex. 1004).
`
`
`7.
`
`For the reasons detailed below, based on my research in this matter, it
`
`is my opinion that Exs. 1002-1004, were each publicly accessible prior to
`
`November 9, 1992, so that interested members of the public could have obtained
`
`the articles with reasonable diligence if they so desired.

`
`

`

`Exhibit 1002:
`
`Ex. 1002 was retrieved from the online database named ACM Digital
`
`Library. The ACM Digital Library is a publisher web site belonging
`
`to a reputable and trusted publisher which publishes online electronic
`
`versions of its paper publications. In 1981, the article named in Ex.
`
`1002 was published in a newsletter and mailed by U.S. Postal Mail to
`
`its subscribers. The newsletter was received by the publisher in June
`
`1981 to be put into production so the publication date of July 1981
`
`was confirmed by the publisher to be accurate.
`
`
`
`The ACM Guide to Computing Literature is the most comprehensive
`
`bibliographic database in existence focused exclusively on the field of
`
`computing. This article has been cited numerous times in articles
`
`published by other authors at other institutions/conferences prior to
`
`the November 9, 1992 timeframe, thereby additionally confirming it
`
`was available and accessible to persons concerned with the art to
`
`which the document relates.

`
`

`

`Ex. 1003 was first made available to the public at the 9th International
`
`Conference on Distributed Computing Systems in 1989. It was published
`
`for conference attendees by IEEE (Institute of Electrical and Electronics
`
`Engineers). IEEE is designed to serve professionals involved in all aspects
`
`of the electrical, electronic, and computing fields and related areas of science
`
`and technology. It was catalogued at the Koninklijke Bibliotheek, National
`
`Library of the Netherlands on January 20, 1989 making it available at the
`
`library and available to the public at that location as well. Furthermore, it
`
`was cited in several subsequent articles at other institutions/conferences
`
`prior to 1992, thereby additionally confirming it was available and
`
`accessible to persons concerned with the art to which the document relates.
`
`Exhibit 1004:
`
`Ex. 1004 was retrieved from the USENIX Association website. The article
`
`was first published in Computing Systems, a quarterly publication of the
`
`USENIX Association. Computing Systems was a journal dedicated to the
`
`analysis and understanding of advanced computing systems, with an
`
`emphasis on systems inspired or influenced by the UNIX tradition. It was
`
`published in the Fall 1991 edition by the University of California Press. It
`
`was mailed to a distribution list of the USENIX Association membership.
`
`Interested members of the public could have obtained the references with
`
`

`
`

`

`reasonable diligence if they so desired. Furthermore, it was cited multiple
`
`times in subsequent articles and at another conference prior to November,
`
`1992, thereby additionally confirming it was available and accessible to
`
`persons concerned with the art to which the document relates.
`
`8. While I am being compensated on behalf of the petitioner at the rate
`
`of $125 per hour for my services in this matter, I have no interest in the proceeding
`
`to which this declaration pertains.
`
`9.
`
`I hereby declare that all statements made herein of my own
`
`knowledge are true and that all statements made on information and belief are
`
`believed to be true; and further that these statements were made with the
`
`knowledge that willful false statements and the like so made are punishable by fine
`
`or imprisonment, or both, under Section 1001 of Title 18 of the United States Code
`
`and that such willful false statements may jeopardize the results of these
`
`proceedings.
`
`
`
`I declare under penalty of perjury under the laws of the United States of
`
`America that the foregoing is true and correct.
