`All right. Can you tell us your name, sir?
`A.
`Val DiEuliis.

`And what do you do for a living?
`A.
`I am an electrical engineer, and I've been so for 45
`years.
`Q.
`Were you hired by the Plaintiffs in this case to
`evaluate the EA Origin Entitlement system for infringement?
`A.
`Yes.
`Q.
`Before we get into your opinions, let's talk a little
`bit about you and some of your background.
`Can you describe for the jury your educational
`background?

`licenses are involved in entitlements from reading that
`language?
`A.
`Well, I had to agree to a lot of licenses in order to,
`first of all, get the account and get the entitlements for my
`game. But rights to play a game, whatever name you want to
`call it, that's -- that's what licensing is. Licensing is,
`if you buy a -- a product, a software product, and you have
`the license to use it, which means you're allowed to use it.
`Q.
`So --
`A.
`Whatever causes that to happen, you know, is a license.
`Q.
`Okay. So if -- if somebody were to suggest that the EA
`Entitlement -- or the EA Origin Entitlement system has
`nothing whatsoever to do with licenses, based on your
`experience of the documents and your experience with
`downloading the game, would you agree or disagree with that
`suggestion?
`A.
`I would disagree.
`Q.
`And why?
`A.
`Well, I think as I just mentioned, as this document
`explains -- and we have some others also -- entitlements are
`licensed rights. So this means -- so this is what licensing
`is. This is something that allows a person to do something
`or use something.
`So entitlements, as far as I'm concerned, are,
`practically speaking, not any different than licensing --
