`PO makes numerous failed attempts to avoid the obviousness of its Claims:
`
`(1) PO fails to rebut Petitioners’ showing that the combinations of references teach
`
`every limitation of the Claims (2) PO fails to rebut Petitioners’ showing it would
`
`have been obvious to combine the cited references; (3) PO fails to rebut
`
`Petitioners’ showing a POSA would have had a reasonable expectation of success
`
`that the combinations would work; and (4) PO fails to demonstrate that it is
`
`entitled to a priority date earlier than November 9, 2012. PO simply failed to rebut
`
`Petitioners’ evidence, and its Claims are invalid.
`
`I.
`
`CLAIM CONSTRUCTION1
`A. “Wireless telephone device” (Claims 1, 5-7, 9, 12)
`No construction of this term is necessary because PO does not tie
`
`construction of this term to any issue in this IPR. If, however, the Board construes
`
`“wireless telephone device,” the BRI is “telephone device that communicates
`
`wirelessly.” This construction is consistent with the ‘641 patent’s disclosure and a
`
`POSA’s understanding. Although the ‘641 patent does not explicitly define
`
`“wireless telephone device,” it describes a device that communicates wirelessly
`
`(e.g., over cellular, Bluetooth, or Digital Satellite). E.g., Ex. 1001 at 2:33-43, 3:62-
`
`64, 5:66-6:6, 9:5-7, 9:26-31, 13:56-59; Ex. 1025¶¶43-44. And, it discloses that the
`
`
`1 PO improperly “incorporates by reference” from its Preliminary Responses, but
`
`arguments not in its Response are waived. 37 C.F.R. §42.6(a)(3).

`device may be an “Internet phone” or “cellular phone.” Ex. 1001 at 12:22, Fig. 4.
`
`PO’s proposed construction (R5-6) should be rejected because it improperly
`
`equates a “wireless telephone device” with a “cellular phone.” 2 A “wireless
`
`telephone device” is not synonymous with and is broader in meaning than a
`
`“cellular phone.” For example, an “Internet phone” that communicates via satellite
`
`is an example of a “wireless telephone device” that is not a “cellular phone.” Ex.
`
`1025¶45. Also, the ‘641 patent does not require communication over a cellular
`
`network. E.g., Ex. 1001 at 2:33-43, 5:66-6:6. In addition, PO improperly limits the
`
`wireless telephone device to one used “without a physical connection to
`
`a[n]…external power source.” R5. The ‘641 patent (including the passages PO
`
`cites—Ex. 1001 at 13:26-28, 18:37-39) does not require the “wireless telephone
`
`device” to “function without needing to be tethered to an external power source.”
`
`See generally Ex. 1001; see also 407 Pap.48 at 11-12. Rather, the ‘641 patent
`
`describes that a physical connection may be used “for powering” the electronic
`
`device. Ex. 1001 at 18:37-39. And, the ‘641 patent consistently uses the term
`
`“wireless” to describe a mode of communication, not how the device is powered.
`
`E.g., Ex. 1001 at 2:28-32, 3:62-64, 4:1-7, 5:18-21, 9:5-7, 9:26-31, 13:56-59; see
`
`also, e.g., Ex. 1026 at 484 (“wireless adj. Of, pertaining to, or characteristic of
`
`

`communications that take place without the use of interconnecting wires or cables,
`
`such as by radio, microwave, or infrared.”); Ex. 1025¶46; 407 Pap.48 at 11-12.
`
`Finally, PO incorrectly assumes that a wireless telephone device must be portable.
`
`R5. A “wireless telephone device” need not be “portable” and may be stationary, in
`
`a fixed location. E.g., Ex. 1025¶46; Ex. 1027 at Fig. 3 (item 55), [0023].
`
`B. “Stream a signal” (Claim 1) /“streaming audio signal” (Claim 8)
`The Board correctly construed “streaming audio signal” to mean “an audio
`
`signal that is transferred in a continuous stream.” ID1 at 7-8; ID2 at 7-8; ID3 at 6-7;
`
`see also Ex. 1015 at 7. The Board’s construction is consistent with the ‘641
`
`patent’s disclosure and the understanding of a POSA. E.g., Ex. 1001 at 8:31-35
`
